Summary: OSCE/ODIHR and the Venice Commission welcome many of the proposals in the draft amendments which, if implemented adequately, can help to further political pluralism in line with international standards on political party regulation.  At the same time, the draft amendments would benefit from certain revisions and improvements to ensure political party registration is not too burdensome, internal party processes are not overregulated and loopholes in political party funding are closed.

ԵԱՀԿ/ԺՀՄԻԳ-ը և Վենետիկի հանձնաժողովը ողջունում են փոփոխությունների նախագծում առաջարկվող բազմաթիվ առաջարկները, որոնց պատշաճ իրականացումը կարող է նպաստել հետագա քաղաքական բազմակարծությանը՝ քաղաքական կուսակցությունների կարգավորման միջազգային չափորոշիչներին համապատասխան:
Միևնույն ժամանակ, փոփոխությունների նախագիծը կշահեր մի շարք վերանայումներից և բարելավումներից, որոնք կերաշխավորեին քաղաքական կուսակցությունների գրանցման համար խիստ ծանրաբեռնող պահանջների, ներկուսակցական գործընթացների գերկարգավորման և քաղաքական կուսակցությունների ֆինանսավորման համար առկա սողանցքների բացառումը։

L'OSCE / BIDDH et la Commission de Venise ont accueilli favorablement plusieurs des projets d’amendement qui, s’ils sont correctement mis en œuvre, peuvent contribuer à promouvoir le pluralisme politique conformément aux normes internationales sur la réglementation des partis politiques. Néanmoins, les amendements  proposés pourraient bénéficier de certaines révisions et améliorations pour que l'enregistrement des partis politiques ne soit pas trop fastidieux, que les processus internes des partis ne soient pas trop réglementés et que les lacunes en ce qui concerne le financement des partis politiques soient comblées.

Summary: ODIHR welcomes the readiness to further improve the Draft Law on ensuring Equality Before the Law, a previous draft of which was assessed in the Interim Opinion on the Draft Law of the Republic of Armenia on Ensuring Equality before the Law (as of November 2018). The Draft Law, in particular in its recently revised version, contains many positive elements which aim to guarantee equality through the legal norms and regulations, covering various forms of discrimination, introduction of special measures, as well as by establishing a special advisory body to combat discrimination within the Human Rights Defender’s Office. At the same time, the Draft Law could benefit from certain revisions and clarifications, to enhance its effectiveness, avoid ambiguity and ensure respect for principles of equality, but also to guarantee effectiveness and credibility of the institution authorized to oversee and apply this Draft Law. It is recommended, for instance, to include additional protected characteristics, specifically referring to sexual orientation and gender identity, as well as national origin and nationality.

ԺՀՄԻԳ-ը ողջունում է «Իրավահավասարության մասին» օրենքի նախագծի հետագա լրամշակման պատրաստակամությունը, որի նախորդ նախագծային տարբերակը գնահատվել էր ««Իրավահավասարության մասին» Հայաստանի Հանրապետության օրենքի նախագծի մասին միջանկյալ կարծիք (2018թ․ նոյեմբերի դրությամբ)» փաստաթղթով։ Օրենքի նախագիծը՝ մասնավորապես դրա վերջերս վերանայված տարբերակը, պարունակում է բազմաթիվ դրական տարրեր, որոնց նպատակն է երաշխավորել հավասարությունը խտրականության տարբեր ձևերին անդրադարձող իրավական նորմերի և կարգավորումների, հատուկ միջոցների, ինչպես նաև Մարդու իրավունքների պաշտպանի գրասենյակի կազմում խտրականության դեմ պայքարի հատուկ խորհրդատվական մարմնի ստեղծման միջոցով։ Միևնույն ժամանակ, Օրենքի նախագիծը կարող էր շահել մի շարք վերանայումներից և հստակեցումներից, որոնք կմեծացնեին դրա արդյունավետությունը, հնարավորություն կտային խուսափել անհստակություններից և ապահովել հարգանքը հավասարության սկզբունքների նկատմամբ, բայց նաև երաշխավորել այս Օրենքի նախագծի վերահսկողությունը և դրա կիրակումն իրականացնելու իրավասություն ունեցող հաստատության արդյունավետությունն ու արժանահավատությունը։ Օրինակ՝ խորհուրդ է տրվում ներառել լրացուցիչ պաշտպանված հատկանիշներ, որոնք մասնավորապես կվերաբերեն սեռական կողմնորոշմանը և գենդերային ինքնությանը, ինչպես նաև ազգային ծագմանն ու ազգությանը։   

Ամփոփում. ԵԱՀԿ/ԺՀՄԻԳ-ն նախևառաջ ողջունում է այն փաստը, որ «Քաղաքական կուսակցությունների մասին» Հայաստանի Հանրապետության սահմանադրական օրենքի 2016 թվականի նախագծի վերաբերյալ ԵԱՀԿ/ԺՀՄԻԳ-ի և Վենետիկի հանձնաժողովի համատեղ եզրակացության մեջ արված առաջարկություններից մի քանիսն հաշվի են առնված Հայաստանի գործող իրավական դաշտում: Համարժեք իրագործման դեպքում օրենքը բազմաթիվ առումներով կարող է նպաստել քաղաքական կուսակցությունների ինքնուրույնության մակարդակի բարձրացմանը և նրանց համար «խաղի» հավասար պայմանների ապահովմանը: Այնուամենայնիվ, ակնհայտորեն առկա են էական թերացումներ, մասնավորապես՝ քաղաքական կուսակցությունների ֆինանսական միջոցների մոնիթորինգի և վերահսկողության բնագավառում, որը կարևորագույն դեր ունի քաղաքական կուսակցությունների գործունեության օրինականության երաշխավորման տեսանկյունից: Բացի դրանից, օրենքի տարատեսակ խախտումների համար պետք է նախատեսել համարժեք պատժամիջոցների տեսականի:

Summary: At the outset, OSCE/ODIHR welcomes that the legal framework currently in place in Armenia implements several recommendations made in the OSCE/ODIHR-Venice Commission Joint Opinion on the Draft Constitutional Law on Political Parties of Armenia of 2016. If adequately implemented, many aspects of the Law can contribute to greater autonomy for political parties and to levelling the playing field among them. However, significant shortcomings are apparent, in particular, in the area of monitoring and oversight of political party finances, which is a vital part of any functioning legal framework in the area of political parties. Additionally, it should be ensured that a catalogue of proportionate sanctions is applicable in cases of violations of the Law.

Summary: ODIHR welcomes efforts to address various forms of discrimination in a comprehensive manner through the Draft Law, which attempts to cover both the private and the public sphere. The Draft Law contains many positive elements which aim to guarantee equality through the legal norms and regulations, introduction of special measures, as well as by establishing a special body to combat discrimination within the Human Rights Defender Institution.  At the same time, the Draft Law would benefit from certain revisions and clarifications, to enhance its effective application, avoid ambiguity as well as to guarantee effectiveness and credibility of the institution authorized to oversee and apply this Draft Law. For these purposes it is recommended, for instance, to include additional protected characteristics, specifically referring to sexual orientation, gender identity, religion and belief, as well as national origin and nationality and to ensure that the Equality Body, as well as non-governmental organisations that have a legitimate interest in it, are entitled to bring cases on behalf or in support of an alleged victim of discrimination.

ԺՀՄԻԳ-ը ողջունում է խտրականության տարբեր ձևերին Օրենքի նախագծի միջոցով համապարփակ կերպով արձագանքելու ջանքերը, որոնցով փորձ է արվում օրենքը կիրառելի դարձնել թե՜ մասնավոր, թե՜ հանրային տիրույթների նկատմամբ: Օրենքի նախագիծը բազմաթիվ դրական տարրեր է պարունակում, որոնց նպատակն է իրավական նորմերի և կարգավորումների միջոցով երաշխավորել հավասարությունը, հատուկ միջոցներ ներդնել, ինչպես նաև խտրականության դեմ պայքարի հարցերով հատուկ մարմին ստեղծել Մարդու իրավունքների պաշտպանի աշխատակազմում: Միևնույն ժամանակ, Օրենքի նախագիծը կբարելավվեր, եթե դրանում արվեին որոշ վերանայումներ և հստակեցումներ, որոնց շնորհիվ կապահովվեր օրենքի արդյունավետ կիրառությունը, կբացառվեին անորոշությունները և կերաշխավորվեին այս օրենքի վերահսկման և կիրառության հարցերով լիազորված կառույցի արդյունավետությունը և վստահելիությունը: Այս իմաստով խորհուրդ է տրվում, օրինակ, ներառել պաշտպանվող լրացուցիչ հատկանիշներ, մասնավորապես՝ նշել սեռական կողմնորոշումը, գենդերային ինքնությունը, կրոնը և հավատը, ինչպես նաև ազգային ծագումը և ազգությունը, միևնույն ժամանակ ապահովելով, որպեսզի Հավասարության մարմինը և համապատասխան իրավաչափ շահ ունեցող հասարակական կազմակերպություններն իրավունք ունենան գործեր հարուցել խտրականությունից ենթադրաբար տուժած անձի անունից կամ ի սատարումն այդ անձի:

Summary: The OSCE/ODIHR and the Venice Commission welcome Armenia’s efforts to amend its existing legal framework with a view to bringing it into compliance with international standards on freedom of religion or belief and note a number of improvements compared to the existing 1991 Law that reflect some of the recommendations made in previous OSCE/ODIHR-Venice Commission joint opinions on Armenian legislation pertaining to freedom of religion or belief. At the same time, it is noted that some positive aspects of the Draft Law as reviewed by the OSCE/ODIHR in its 2017 Opinion have been removed from the current version of the Draft Law. Moreover, some key recommendations from previous opinions have not been addressed and the Draft Law still raises issues on several points that should be carefully addressed prior to adoption, especially regarding the scope and wording of the provisions on limitations to the manifestation of freedom of religion or belief, the rights enjoyed by all, registered or unregistered, religious or belief communities, and the requirements for registering religious organisations.

Ամփոփում. ԵԱՀԿ/ԺՀՄԻԳ-ը և Վենետիկի հանձնաժողովը ողջունում են այն փաստը, որ Հայաստանը ջանքեր է գործադրում իրավական դաշտը փոփոխելու և կրոնի կամ հավատի ազատության միջազգային չափանիշներին համապատասխանեցնելու ուղղությամբ: Հարկ է հիշատակել, որ մի շարք բարելավումներ են արվել՝ 1991 թվականի գործող օրենքի համեմատությամբ, որոնք արտացոլում են կրոնի կամ հավատի ազատության մասին Հայաստանի օրենսդրության վերաբերյալ ԵԱՀԿ/ԺՀՄԻԳ-ի և Վենետիկի հանձնաժողովի նախկին համատեղ եզրակացություններում արված առաջարկությունների որոշ մասը: Միևնույն ժամանակ, ընդգծվում է այն հանգամանքը, որ Օրենքի նախագծի ներկայիս տարբերակից հանվել են որոշ բարելավված դրույթներ, որոնք առկա էին նախագծի այն տարբերակում, որի վերաբերյալ կազմվել և ներկայացվել էր ԵԱՀԿ/ԺՀՄԻԳ-ի 2017 թվականի եզրակացությունը: Ավելին, նախկին եզրակացություններում արված որոշ կարևոր առաջարկություններ հաշվի առնված չեն, և Օրենքի նախագիծը շարունակում է խնդիրների տեղիք տալ մի քանի հարցերի կապակցությամբ, որոնք հարկ է զգուշորեն ուսումնասիրել նախքան նախագծի ընդունումը, հատկապես` կապված կրոնի կամ հավատի ազատության դրսևորման սահմանափակումներին վերաբերող դրույթների ձևակերպման և շրջանակի հետ, բոլոր՝ գրանցված և չգրանցված կրոնական կամ հավատքային համայնքներ ունեցած իրավունքների հետ, ինչպես նաև կրոնական կազմակերպությունների գրանցմանը վերաբերող պահանջների հետ:

Summary: Overall, the Opinion welcomes the fact that the Draft Law reflects some of the recommendations made in previous OSCE/ODIHR-Venice Commission joint opinions on Armenian legislation pertaining to freedom of religion or belief. At the same time, further amendments are needed to ensure the Draft Law’s full compliance with international standards and OSCE human dimension commitments, particularly regarding some unjustified restrictions to the right to freedom of religion or belief which should be removed or limitations which should be more strictly circumscribed.

Ամփոփում. Եզրակացության մեջ ընդհանուր առմամբ ողջունելի է համարվում այն փաստը, որ Օրենքի նախագծում հաշվի է առնված կրոնի կամ հավատի ազատության մասին Հայաստանի օրենսդրության վերաբերյալ ԵԱՀԿ/ԺՀՄԻԳ-ի և Վենետիկի հանձնաժողովի նախկին համատեղ եզրակացություններում արված առաջարկությունների որոշ մասը: Միևնույն ժամանակ, լրացուցիչ փոփոխություններ են անհրաժեշտ, որպեսզի Օրենքի նախագիծը լիովին համապատասխանի միջազգային չափանիշներին և ԵԱՀԿ-ի մարդկային տարածաչափի շրջանակում ստանձնված հանձնառություններին, մասնավորապես՝ կրոնի կամ հավատի ազատության իրավունքի որոշ չհիմնավորված սահմանափակումների մասով, որոնք անհրաժեշտ է հանել օրենքի տեքստից կամ ձևակերպել ավելի նեղ իմաստով:

Summary: The Joint Opinion comments the aim of the draft law to liberalise the formation and registration of political parties in Armenia and the envisaged changes in regard to territorial and membership requirements. However, while the law may create a legal backdrop for improving internal democracy, the Joint Opinion cautions that regulating intra-party organisation excessively may not be useful for achieving such. In particular, it is recommended to consider reducing the number of provisions on internal procedures and functioning of political parties, to improve the rules on donations to political parties, to clarify the rules concerning the suspension of political parties, to consider including further measures to promote gender equality and diversity within internal party structures, to consider providing opportunities for non-party candidates to be included in party lists, to equip the Audit and Oversight Service with additional powers to ensure transparent reporting by all contestants.

Summary: The Opinion raises key issues and provides indications of areas of concern. In the interests of conciseness, the Opinion focuses more on those provisions that may be improved rather than on the positive aspects of the Draft Rules of Procedure. The ensuing recommendations are based on international standards and practices related to constitutional matters and parliamentary practice. Moreover, in accordance with the 2004 OSCE Action Plan for the Promotion of Gender Equality and commitments to mainstream a gender perspective into OSCE activities, the Opinion analyses the potentially different impact of the Draft Rules of Procedure on women and men.

Summary: While the Opinion acknowledges that the Draft Amendments overall improve the transparency of criminal investigations, it also provides concrete recommendations for improvement, in particular to guarantee the impartiality and independence of attesting witnesses during criminal proceedings. 

Ամփոփում. Թեպետ Եզրակացության մեջ նշվում է, որ փոփոխությունների նախագծով ընդհանուր առմամբ բարելավվում է քրեական գործերի քննության թափանցիկությունը, այնուամենայնիվ, միևնույն ժամանակ ներկայացվում են բարելավման մասին կոնկրետ առաջարկություններ, մասնավորապես՝ առաջարկություն քրեական վարույթում ցուցմունք տվող վկաների անկողմնակալությունը և անկախությունը երաշխավորելու մասին:
