LAW OF THE REPUBLIC OF UZBEKISTAN

ON THE ELECTION OF CITIZENS’ SUFFRAGE

Article 1. Citizens of the Republic of Uzbekistan shall have the right to take part in public and state affairs management both as directly and through their representatives. This right shall be implemented by citizen’s participation in referendums, election of the President of the Republic of Uzbekistan and the representative bodies of authority.

Article 2. Suffrage of citizens of the Republic of Uzbekistan, vested by the Constitution, the present Law and other legislative acts, shall be under the state protection.

Article 3. Citizens of the Republic of Uzbekistan regardless of their origin, social and property status, race and nationality, sex, education, language, religion, occupation shall enjoy equal suffrage.

Article 4. Citizens of the Republic of Uzbekistan shall have the right to elect and be elected.

The right to vote shall have citizens of the Republic of Uzbekistan who have reached the age of 18. Every citizen-voter shall have one vote.

The right to be elected the President of the Republic of Uzbekistan shall have citizens of the Republic of Uzbekistan who have reached the age of 35.

The right to be elected to the Oliy Majlis of the Republic of Uzbekistan shall have  citizens of the Republic of Uzbekistan who have reached the age of 25 by election day.

The right to be elected to the local representative bodies of authority shall have citizens of the Republic of Uzbekistan who have reached the age of 21 by election day.

Article 5. Direct or indirect restriction of citizens’ suffrage, except the requirements prescribed by the legislative acts on the election, shall not be permitted.

Article 6. Voters, regardless of the place of their location, shall be guaranteed the right to directly participate in referendums, the election of the President of the Republic of Uzbekistan and the representative bodies of authority.

Article 7. Voters shall have the right for free will and secret ballot. Polling station committees, arranging the poll in specially allocated premises, shall provide citizens with the opportunity for free and secret self-determination.

Control over voters’ self-determination shall not be permitted.

Article 8. Citizens of the Republic of Uzbekistan, who have reached the age of 18 by or on election day, perma­nently or temporarily residing on the territory of the respective polling station, shall have the right to be included into electo­ral registers.

Every voter may be included only into one electoral register.

Article 9. Voters shall be provided with the opportunity to familiarize themselves in advance with electoral register in the premise of polling station committee.

Article 10. Voter shall have the right to appeal polling station committee for error or inaccuracy in electoral register. Within 24 hours, polling station committee shall be obliged to verify the application and either to correct the error, or issue a reference justifying the decline of his statement to the applicant.

Article 11. Voter, who for some reasons was not included in proper time into electoral register, shall be included by polling station committee on the basis of the document identifying voter’s personality, citizenship and place of residence.

Article 12. Voters shall have the right to agitate for or against the decisions submitted for the nationwide voting, for and against candidates to the President of the Republic of Uzbekistan and candidates to representative bodies of authority.

Voters shall be guaranteed the right to exercise their public activities in the form of meetings, assemblies and demonstrations in accordance with the legislation of the Republic of Uzbekistan.

Article 13. For arranging pre-election meetings bodies of state authority shall be obliged to provide voters with equipped premises, necessary reference and information materials. Voters shall be notified in advance of time and place for arranging assemblies and meetings.

Article 14. The election campaign shall be organized on the basis of wide publicity. Every voter shall have the right, in the course of the election, to search, receive and distribute information related to the formation of electoral districts and polling stations, composition of electoral committees, location and work schedule of committees, election returns of candidates, the poll and election.

Decisions of the respective electoral committees, related to the formation of electoral districts and polling stations, composition of electoral committees, as well as results of registration of candidates, the poll and election, shall be published in the press.

Article 15. Voters shall have the right to familiarize with the program for future activities of political parties and individual candidates taking part in the election.

Article 16. Citizens  of the Republic of Uzbekistan, who have suffrage, but are not members of any political party, as well as candidates or their proxies may be members of electoral committees.

Article 17. Voters shall be guaranteed the right to replace  spoiled voting paper with a new one on election day. Voting paper shall be replaced by the respective polling station committee.

Article 18. Voters, who are unable on election day to stay in his place of residence, shall have the right to vote in advance.

The respective polling station committee, upon request of voters, shall issue voting lists of the specified form stating the corresponding data about candidates. Voters may leave  filled in voting list in sealed envelope for one of members of  polling station committee.

Article 19. Voters, who are unable to arrive in voting building due to bad health or  some other reasons, shall have the right to appeal polling station committee for corres­ponding request which is obliged to arrange the poll in the place of their stay.

Article 20. Every citizen of the Republic of Uzbekistan shall be guaranteed legal protection of his suffrage, possi­bility to appeal against illegal actions of electoral committees, state bodies, officials, public associations in the court.

Article 21. Preventing citizens by violence, fraud, inti­midation or any other way from exercising their right to elect and be elected, to take part in referendum, to conduct canvassing, as well as forging of documents, deliberate falsification of election returns, other violations of laws on referendum, the election of the President, as well as election to representative bodies of authority shall bear responsibility in accordance with the laws of the Republic of Uzbekistan.
