Chapter 1

General Provisions

§ 1. Scope of application of Act

(1) This Act provides the procedure for publication in the Riigi Teataja of legislation and international agreements of the Republic of Estonia, reasoned decisions of the Supreme Court of the Republic of Estonia, notices and other documents, and for access thereto.

(2) Legislation subject to publication in the Official Journal of the European Union shall not be published in the Riigi Teataja.

§ 11. Riigi Teataja

(1) The Riigi Teataja is the official publication of the Republic of Estonia. The Riigi Teataja shall be published on paper as printed matter and electronically on the Internet.

(2) Legislation, notices and other documents published in the Riigi Teataja which is on paper and in electronic form have equal legal force, unless this Act provides otherwise.

§ 2. Legislation and other documents published in Riigi Teataja

The following shall be published in the Riigi Teataja:

1) Acts passed by referendums and by the Riigikogu2 which have been proclaimed by the President of the Republic, and decisions of referendums on national issues;

2) bills and draft resolutions on national issues submitted to referendums;

3) international agreements ratified by the Riigikogu and international agreements entered into by the Government of the Republic, excluding international agreements which are entered into on the basis of the Treaty on European Union, the Treaty establishing the European Community or the Euratom Treaty and are subject to publication in the Official Journal of the European Union;

4) resolutions, statements, declarations and addresses of the Riigikogu;

5) decrees, resolutions and directives of the President of the Republic, except resolutions concerning proclamation of Acts;

6) decisions of the National Electoral Committee concerning the registration of candidates for President of the Republic, concerning election of the President of the Republic, the Riigikogu and the Board of the Riigikogu and elections to the European Parliament, concerning the results of referendums, and concerning the assumption of office as members of the Riigikogu by alternate members of the Riigikogu if members of the Government of the Republic are elected to the Riigikogu and concerning the assumption of office as Members of the European Parliament by alternate Members of the European Parliament and concerning termination of the authority of Members of the European Parliament and notices issued by the National Electoral Committee concerning the postponement or cancellation of a referendum;

7) resolutions of the Board of the Riigikogu concerning the assumption of office as members of the Riigikogu by alternate members of the Riigikogu and the termination of authority of members of the Riigikogu, approval of the membership of the standing committees of the Riigikogu, and registration of the factions of the Riigikogu and approval of the membership thereof;

8) regulations and orders of the Government of the Republic, except orders which set out a different procedure for giving notification;

9) orders of the Prime Minister if provided by law;

10) regulations of ministers, and directives of ministers if provided by an Act or a regulation of the Government of the Republic;

§ 3. Notices published in Riigi Teataja

(1) Pursuant to Acts, the following notices are published in the Riigi Teataja:

1) declarations of economic interests of officials specified in subsection 15 (2) of the Anti-corruption Act (RT I 1999, 16, 276; 87, 791; 2000, 25, 145; 2001, 58, 357; 2002, 53, 336; 63, 387) and official notices specified in subsection 18 (3) of the Anti-corruption Act;

2) notices of the Security Police Board pursuant to subsection 8 (1) of the Procedure for Registration and Disclosure of Persons who Have Served in or Co-operated with Intelligence or Counter-intelligence Organisations of Security Organisations or Military Forces of States which Have Occupied Estonia Act (RT I 1995, 17, 233; 1999, 16, 271; 2002, 50, 314; 61, 375);

(2) The obligation to publish notices in the Riigi Teataja is provided in Acts regulating the corresponding area and in subsection (1) of this section. Notices concerning which there is an obligation to publish in the Riigi Teataja provided for in Acts regulating only the corresponding area shall be published in the official publication Ametlikud Teadaanded7.

(3) Documents not provided for in § 2 of this Act or subsection (1) of this section may be published in the Riigi Teataja on the decision of the State Secretary.

§ 4. Restrictions on publication of some legislation and other documents

(1) Legislation of specific application of the President of the Republic, the Government of the Republic and of ministers which regulates national security, national defence or surveillance and which does not restrict the rights and freedoms of persons outside the service thereof or impose duties thereon is published pursuant to the procedure prescribed in the legislation. Legislation which contains state secrets is not published in the Riigi Teataja.

(2) If publication of legislation, an annex thereto or another document in the Riigi Teataja published on paper proves to be unjustified technically or due to the length of a specified document, the specified document may be published in full extent only in the electronic Riigi Teataja. In such case, a notice or notation concerning publication of the document in the electronic Riigi Teataja shall be published in the Riigi Teataja published on paper and, if necessary, information as to where and pursuant to which procedure the document can be examined shall also be added.

(21) Subsection (2) of this section does not apply in the case of Acts.

(22) The State Secretary may decide, with the approval of the agency which presented legislation or another document for publication, not to publish an annex to the legislation or the other document in the Riigi Teataja if the publication is technically impossible. In such case, information as to where and pursuant to which procedure the annex or the other document can be examined shall be published.

(3) Concerning entry into a contract under public law which regulates an unlimited number of similar cases, a notice may be published in the Riigi Teataja indicating pursuant to which procedure such contract is made public.

§ 5. Entry into force of legislation published in Riigi Teataja

(1) Acts which amend the Constitution enter into force on the date provided for in the Acts but not earlier than three months after proclamation.

(2) Acts passed by referendums or the Riigikogu and which have been proclaimed by the President of the Republic, or decrees of the President of the Republic enter into force on the tenth day following the date of publication in the Riigi Teataja unless another date is provided in the Act.

(3) Decisions on national issues passed by referendum enter into force on the day following the publication of a decision on approval of the referendum results in the Riigi Teataja.

(4) Resolutions of the Riigikogu or the President of the Republic enter into force upon signature thereof unless another term is provided in the resolution.

(5) Regulations of the Government of the Republic, ministers, the National Electoral Committee or the President of the Bank of Estonia enter into force on the third day after publication in the Riigi Teataja unless a later date is provided in the regulation.

(51) A contract under public law regulating an unlimited number of cases and published in the Riigi Teataja shall enter into force on the third day after publication. In the event of publication of a notice concerning entry into a contract under public law, such contract shall enter into force on the date provided for in the contract but not earlier than three days after publication of the contract.

(6) Orders of the Government of the Republic, orders of the Prime Minister, directives of ministers or resolutions of the Board of the Bank of Estonia enter into force upon signature thereof unless a later date is provided in the legislation.

(7) Decisions of the National Electoral Committee concerning the results of Riigikogu elections and elections to the European Parliament enter into force on the date following publication in the Riigi Teataja.

(10) International agreements enter into force pursuant to the procedure provided in the agreement.

(11) Court judgments or court rulings enter into force pursuant to the procedure provided for in Acts concerning court procedure.

(12) Legislation issued on the basis of the State of Emergency Act (RT I 1996, 8, 165; 2002, 57, 354; 62, 376; 63, 387) or the Emergency Situation Act (RT I 1996, 8, 164; 1999, 57, 598; 2002, 57, 354; 61, 375; 63, 387) enters into force pursuant to the procedure prescribed in these Acts.

(13) Local government regulations published in the electronic Riigi Teataja shall enter into force pursuant to the procedure provided for in the Local Government Organisation Act (RT I 1993, 37, 558; 1999, 82, 755; 2000, 51, 322; 2001, 82, 489; 100, 642; 2002, 29, 174; 36, 220; 50, 313; 53, 336; 58, 362; 61, 375; 63, 387; 64, 390 and 393; 82, 480; 96, 565; 99, 579; 2003, 1, 1; 4, 22).

§ 6. Entry into force of provision delegating authority

Provisions delegating authority to the Government of the Republic or ministers to pass regulations enter into force on the tenth day after publication of the Act in the Riigi Teataja unless another date of entry into force of the provision delegating authority is provided in the Act. Regulations passed on the basis of provisions delegating authority do not enter into force before the entry into force of the Act unless otherwise provided for in the Act.

§ 7. Publisher of Riigi Teataja

The Riigi Teataja is published by the State Chancellery.

§ 71. Electronic Riigi Teataja

(1) The electronic Riigi Teataja is a general national register.

(2) The electronic Riigi Teataja belongs to the state.

(3) Legislation and other documents specified in §§ 2 and 3 of this Act, and consolidated texts of legislation in the cases prescribed by this Act, and regulations of local governments submitted for publication shall be published in the electronic Riigi Teataja. All documents sent for publication in the Riigi Teataja are the source documents of the electronic Riigi Teataja.

(4) Legislation and other documents shall be published in the electronic Riigi Teataja at the same time with their publication in the Riigi Teataja published on paper. The new consolidated text of a legislative act shall be submitted at the same time with publication of the amending legislative act in the Riigi Teataja.

(5) The requirement of simultaneity specified in subsection (4) of this section applies to the control copies of Riigi Teataja booklets which are sent to the Chancellery of the Riigikogu, the Supreme Court, the Office of the President of the Republic, the Office of the Chancellor of Justice and the State Chancellery, and to libraries pursuant to the Compulsory Copy Act (RT I 1997, 16, 259; 1998, 61, 983; 2002, 61, 375; 63, 387).

§ 72. Chief processor of electronic Riigi Teataja

(1) The State Chancellery is the chief processor of the electronic Riigi Teataja.

(2) The State Chancellery shall direct and arrange for the maintenance of the electronic Riigi Teataja and shall instruct the authorised processor and the respondents and shall monitor how they perform their functions.

(3) The functions of the authorised processor of the electronic Riigi Teataja may be assigned to an agency administered by the State Chancellery to the extent designated by the State Secretary or a contract under public law for the performance of the functions of the authorised processor may be entered into.

§ 73. Authorised processor of electronic Riigi Teataja

(1) The State Secretary shall appoint the authorised processor of the electronic Riigi Teataja.

(2) The functions of the authorised processor of the electronic Riigi Teataja may be performed by the State Chancellery or another state agency or a legal person in private law on the basis of a contract under public law.

(6) Upon premature termination of a contract, an authorised processor is required to transfer the electronic Riigi Teataja database together with the hardware and software necessary for publication within the term prescribed in the contract. If the hardware belongs to the authorised processor, the authorised processor is required to grant the use of the hardware to the chief processor for the charge and within the term prescribed in the contract in order to publish the electronic Riigi Teataja uninterruptedly.

§ 74. Competence of authorised processor

(1) The authorised processor shall ensure the working order of the information system necessary for publication of the electronic Riigi Teataja and the accessibility of the electronic Riigi Teataja through computer networks.

(2) The authorised processor shall not amend information entered in the electronic Riigi Teataja.

Chapter 2

Content and Format of Riigi Teataja Publication

§ 8. Titles and design of parts of Riigi Teataja published on paper

(1) The Riigi Teataja is published in four parts as a non-periodical publication.

(2) The great national coat of arms appears at the top centre of the front page of Riigi Teataja booklets, under which the title “Riigi Teataja” is written on booklets of Parts I, II and III and “Riigi Teataja Lisa3” is written on booklets of Part IV.

(3) On the front page of Riigi Teataja booklets, the following subtitle is written under the title:

1) Part I - “Riigikogu, Vabariigi Presidendi ja Vabariigi Valitsuse õigusaktid4”;

2) Part II - “Välislepingud, muud välissuhtlemisalased õigusaktid ja teadaanded5”;

3) Part III – “Riigikohtu lahendid6”.

(4) The sequence number, date of publication and contents of a Riigi Teataja booklet are written below the title and subtitle of the booklet.

§ 9. Division of legislation and notices between parts

(1) The following are published in Part I of the Riigi Teataja:

1) in division one – Acts passed by referendums which have been proclaimed by the President of the Republic and decisions of referendums on national issues, bills and other draft resolutions on national issues submitted to referendums, Acts passed by the Riigikogu which have been proclaimed by the President of the Republic, the consolidated texts thereof and decrees of the President of the Republic;

2) in division two – resolutions, statements, declarations and addresses of the Riigikogu;

3) in division three – regulations of the Government of the Republic and the consolidated texts thereof;

4) in division four – decisions of the National Electoral Committee concerning the results of referendums, concerning the results of elections of the President of the Republic, the Riigikogu and the Board of the Riigikogu and elections to the European Parliament, concerning the registration of candidates for President of the Republic and concerning the assumption of office as members of the Riigikogu by alternate members of the Riigikogu, and concerning the assumption of office as Members of the European Parliament by alternate Members of the European Parliament and concerning termination of the authority of Members of the European Parliament, and resolutions of the Board of the Riigikogu concerning the assumption of office as members of the Riigikogu by alternate members of the Riigikogu and the termination of their authority, approval of the membership of the standing committees of the Riigikogu, and registration and approval of the membership of the factions of the Riigikogu, and notices concerning the postponement or cancellation of a referendum.

(2) The following are published in Part II of the Riigi Teataja:

1) in division one – Acts which ratify or denounce international agreements, and international agreements specified in clause 2 3) of this Act;

2) in division two – orders of the Government of the Republic concerning foreign relations;

3) in division three – resolutions of the President of the Republic concerning appointment and removal of diplomatic representatives, orders of the Government of the Republic with regard to granting authorisation concerning foreign relations, and notices of the Ministry of Foreign Affairs.

(3) The following are published in Part III of the Riigi Teataja, “Riigikohtu lahendid”:

1) in division one – decisions of the Supreme Court en banc;

2) in division two – decisions of the Constitutional Review Chamber of the Supreme Court;

3) in division three – decisions of the Administrative Law Chamber of the Supreme Court, the Criminal Chamber of the Supreme Court, the Civil Chamber of the Supreme Court and the Special Panel of the Supreme Court.

(4) The following are published in Part IV of the Riigi Teataja, “Riigi Teataja Lisa”:

1) in division one – regulations of ministers, the President of the Bank of Estonia and the National Electoral Committee and contracts under public law entered into by ministries and the State Chancellery to regulate an unlimited number of cases, and notices concerning entry into such contracts and the guidelines of the Accounting Standards Board;

(41) Regulations of local governments submitted for publication shall be published in the Riigi Teataja in the Part of the electronic Riigi Teataja Local Government Legislation”.

(5) Court judgments or court rulings which have entered into force and legislation passed by way of supervisory control which amend or repeal legislation or documents published in the Riigi Teataja or which suspend their validity or enforcement shall be published in the Part and division of the Riigi Teataja where the corresponding legislation or document was published.

§ 10. Publication of international agreements

(1) If the Estonian and foreign language texts of an international agreement are authentic, the text of the agreement is published only in Estonian.

(2) If the authentic text of an international agreement is only in a foreign language or languages, the translation of the international agreement into Estonian and the authentic text in the foreign language which is the basis for the translation are published.

(3) If the Estonian and foreign language texts of an international agreement are authentic but it has been agreed that, in the event of dissenting opinions, the interpretation of the agreement is based on the foreign language text, the text of the agreement is published in Estonian and in the foreign language which is the basis for interpretation.

§ 11. Formalities for publication of legislation

(1) An Act is published together with a reference to the resolution of the President of the Republic concerning proclamation of the Act which sets out the number and date of the resolution. This is followed by the title, date of passage and text of the proclaimed Act and, after the text, the official title and name of the person who signed the Act.

(2) A decree of the President of the Republic is published together with the title of the decree followed by the date and text of the decree and, after the text, the official titles and names of the persons who signed the decree.

(3) A resolution or directive of the President of the Republic, a regulation or order of the Government of the Republic, an order of the Prime Minister, a regulation of a minister, or other legislation is published together with the title, followed by the issuer, date, name, number and text of the legislation, and the official titles and names of the persons who signed the legislation. If legislation of specific application of the Government of the Republic or of ministers is published which contains sensitive personal data or in which the use of initials is provided for in order to protect personal data, initials may be used instead of the given and family name of the person.

(4) An international agreement is published together with the title, the date on which the agreement was entered into or signed, and the official titles and names of the persons who signed the agreement;

(5) Court judgments and court rulings shall be published in the form provided for in Acts concerning court procedure.

§ 12. Numeration of booklets and articles of Riigi Teataja

(1) The numeration of the booklets of each part of the Riigi Teataja begins each year with number one.

(2) Legislation, international agreements and reasoned decisions of the Supreme Court are published in all parts of the Riigi Teataja under separate article numbers, beginning each year with number one.

(3) Notices to be published in the Riigi Teataja, except notices provided for in clause 2 6) of this Act, reports and overviews, do not comprise articles.

(4) The abbreviations used for Parts I, II, III and IV of the Riigi Teataja are RT I, RT II, RT III and RTL, respectively. In the electronic Riigi Teataja, the abbreviation “KO” shall be used for the part “Local Government Legislation".

§ 13. Use of publication citation

(1) Upon amendment or repeal of a legislative act published in the Riigi Teataja, a publication citation of the first original text and last amendment of the legislative act to be amended or repealed shall be indicated in the amending or repealing legislative act.

§ 14. Riigi Teataja search system

(2) In order to use the electronic Riigi Teataja by using a computer search system, access to legislation and other documents shall be ensured on the basis of the key-word, chronology, the issuer of the legislation, type of the legislation, title of the legislation, publication citation of the legislation, references, time of establishment and entry into force of the legislation, and other data relating to the legislation or documents, and by the full text search.

Chapter 3

Organisation of Publication of Legislation, Notices and Other Documents

§ 15. Presentation for publication of legislation and other documents

(1) Legislation or other documents shall be presented for publication in the Riigi Teataja pursuant to the instructions provided by the State Chancellery, in electronic form, not later than on the working day following the proclamation or signature of the legislation or other documents.

As an exception and with the approval of the State Chancellery, the legislation and other documents may be presented for publication on paper.

(2) The following shall send legislation and other documents for publication:

1) the Chancellery of the Riigikogu, Acts passed by referendums or the Riigikogu and proclaimed by the President of the Republic, bills and other draft resolutions on national issues submitted to referendums, resolutions, statements, declarations and addresses of the Riigikogu, resolutions of the Board of the Riigikogu, and, after deliberation in the Riigikogu, overviews of the Auditor General and the Legal Chancellor;

2) the Office of the President of the Republic, decrees, directives and resolutions of the President of the Republic;

3) the State Chancellery, regulations and orders of the Government of the Republic, notices of the State Secretary;

5) the National Electoral Committee, regulations of the National Electoral Committee and notices and decisions of the National Electoral Committee subject to publication in the Riigi Teataja;

6) the Ministry of Foreign Affairs, international agreements entered into by the Government of the Republic and notices concerning the entry into force or expiry of international agreements;

7) the Bank of Estonia, regulations of the President of the Bank of Estonia, and resolutions and reports of the Board of the Bank of Estonia on the activities of the Bank of Estonia;

(3) The State Chancellery is the person submitting data on legislation and other documents to the electronic Riigi Teataja.

(4) For forwarding legislation and other documents by the electronic data system of the Riigi Teataja, the authorised processor shall grant access to the system to the persons appointed by the persons submitting data and data recipients.

§ 16. Terms for publication of legislation

(1) Acts shall be published in the Riigi Teataja within seven working days after receipt thereof in the State Chancellery. Acts concerning accession to international agreements and Acts concerning their acceptance, approval and ratification and the international agreements appended thereto shall be published within twenty working days after receipt thereof in the State Chancellery.

(2) Legislation and documents not provided for in subsection (1) of this section shall be published in the Riigi Teataja within ten working days after receipt thereof by the State Chancellery.

(3) The State Secretary may extend to up to thirty days the term for publication of legislation which is particularly long or contains graphically complicated elements.

§ 17. Correction of errors in format and language and typing errors in legislation and other documents

(1) During the publication process, the State Chancellery may make corrections and amendments to the publication citations of legislation and other documents to be published and correct typing errors of which the issuer of the legislation or the agency which presented the legislation for publication is informed. In the case of linguistic errors and errors in format, the agency which presented the legislation or other documents shall present for publication the text or part thereof which is correct linguistically, in the correct format and signed by an official responsible therefor.

(2) For technical reasons, the State Chancellery may change the format of graphic material with the approval of the agency which presents the legislation or other documents for publication.

(3) If the published text of legislation or another document contains errors in format and language and typing errors, a correction notice shall be published in the Riigi Teataja for the correction of the errors and the chief processor shall correct the errors also in the electronic Riigi Teataja in the original text of the legislation or other document and in all versions of the consolidated text.

(31) The errors specified in subsection (3) of this section shall be corrected as follows:

1) if the published text does correspond to the text presented for publication, the State Chancellery shall correct an error at the request and with the consent of the issuer of the legislation;

2) if the published text corresponds to the text presented for publication, the issuer of the legislation shall submit to the State Chancellery an application for the correction of errors together with the amended text on the condition that correction of the error does not affect the content of the legislation.

(32) In the case of an error specified in subsection (3) of this section only in the electronic Riigi Teataja, the chief processor shall organise the correction of the error and shall indicate the date and time of correction of the error at the end of the provision.

(4) If the issuer of legislation finds that the text of the issued legislation requires correction before publication, the issuer may suspend publication of the legislation and send a new text of the legislation for publication.

(5) Before publication, the State Chancellery has the right to draw the attention of the issuer of legislation or another document to errors in format and language and typing errors in the text presented for publication and suspend publication of the legislation or other document and inform the agency which presented the legislation or other document for publication thereof.

§ 18. Preparation and publication of consolidated texts of legislation

(1) A consolidated text is the version of legislation which sets out all amendments made to the legislation. The first original text is at the same time also the first version of the consolidated text.

(2) A consolidated text shall be prepared and published electronically after establishment of each amendment to the legislation and after repeal of the legislation.

(3) The consolidated texts of the following legislation shall be published in the electronic Riigi Teataja publication:

1) Acts;

2) decrees of the President of the Republic;

3) regulations and orders of the Government of the Republic;

4) regulations of ministers;

5) regulations of the President of the Bank of Estonia;

6) regulations of the National Electoral Committee;

(4) The following are the persons submitting data concerning consolidated texts to the electronic Riigi Teataja:

1) the Ministry of Justice - Acts and decrees of the President of the Republic;

3) ministries - regulations of appropriate ministers;

4) the Bank of Estonia - regulations of the President of the Bank of Estonia;

5) the Chancellery of the Riigikogu - regulations of the National Electoral Committee.

(5) Upon preparation and publication of a consolidated text, the publication citations and dates of entry into force of the first version of the consolidated text of legislation, of all legislation amending the legislation and of the original text of the repealing legislation shall be set out in the consolidated text.

(6) The issuer of legislation or the State Secretary shall decide on the publication of the consolidated text of legislation in the Riigi Teataja published on paper with the approval of the Minister of Justice.

(7) The State Secretary shall provide instructions concerning the preparation of the consolidated text of legislation.

§ 19. Application of published documents upon non-correspondence thereof

(1) If the texts of the same legislation or other document in the electronic Riigi Teataja and the Riigi Teataja published on paper or published pursuant to the procedure provided for in subsection 4 (2) of this Act are contradictory, the text published on paper applies and the State Chancellery shall be notified of the contradiction.

(2) If the consolidated text of legislation does not correspond to the original text of the legislation or legislation amending or repealing thereof, a court may refuse to apply the consolidated text and notify the State Chancellery of the contents of the non-correspondence.

(3) In the cases specified in subsections (1) and (2) of this section, the State Chancellery shall verify, in cooperation with the agency or person who submitted legislation or another document, the correspondence of texts and shall correct errors pursuant to the procedure provided for in subsections 17 (3), (31) and (32). Verification shall be carried out and errors shall be corrected within five working days as of the date of submission of a corresponding petition.

§ 20. Organisation of translation into foreign languages of legislation published in Riigi Teataja

The Ministry of Justice shall organise the translation of the published legislation into foreign languages.

§ 21. Publication of legislation, other documents and notices in other publications

(1) Legislation and consolidated texts of legislation published in the Riigi Teataja may be published in other publications and websites only with a notation that the official text has been published in the Riigi Teataja and a reference or link to the website of the electronic Riigi Teataja shall be added thereto.

(2) Before publication in the Riigi Teataja, legislation and notices may only be published with the permission of the State Secretary.

(3) Before publication in the Riigi Teataja, the texts of international agreements may be published in other publications with the approval of the Ministry of Foreign Affairs.

§ 22. Covering of publication costs

(1) No fee is charged for publication of legislation, other documents and notices in the Riigi Teataja. The publication and distribution costs thereof shall be borne by the persons who order or buy the Riigi Teataja.

(2) The costs of maintaining the electronic Riigi Teataja shall be covered from the state budget.

§ 24. Official publication Ametlikud Teadaanded

(1) Ametlikud Teadaanded is an official publication which is published in electronic form in the Internet and is issued by the State Chancellery. The State Chancellery may assign to a state agency administered thereby the duty to organise the publication of the official publication Ametlikud Teadaanded, or enter into a contract to this effect with a legal person in private law pursuant to the Public Procurement Act (RT I 2000, 84, 534; 2001, 40, 224; 50, 284; 2002, 23, 131; 47, 297; 61, 375; 63, 387; 87, 505; 99, 577).

§ 241. Presentation and publication of notices

(1) A notice shall be presented for publication on paper and, pursuant to the instructions of the publisher, in electronic form.

(2) Notices shall be published in unaltered form. The person who presents a notice is responsible for the correctness of the notice presented for publication.

(3) If the text of a published notice contains errors in format and language and typing errors, the publisher of Ametlikud Teadaanded shall be notified thereof. In order to publish a correction notice, the person who submitted the notice shall submit a correct notice. The publisher of Ametlikud Teadaanded shall publish a correction notice by the corresponding notice, shall make a notation concerning correction of the error and shall correct the error in the text of the notice.

§ 38. Amendment of Commercial Code

1) in subsection 29 (1), the words "Riigi Teataja Lisa and in the publication designated by the registrar" are substituted by the words "official publication Ametlikud Teadaanded";

2) section 30 is repealed;

3) in subsection 451 (2), the words "Riigi Teataja Lisa and in the publication designated by the registrar" are substituted by the words "official publication Ametlikud Teadaanded";

4) in subsection 57 (3), the words "Riigi Teataja Lisa and in the publications in which the existing registrar and the new registrar publish notices" are substituted by the words "official publication Ametlikud Teadaanded";

5) in subsection 60 (1), the words "Riigi Teataja Lisa and in the publication designated by the registrar" are substituted by the words "official publication Ametlikud Teadaanded";

6) in subsection 212 (1), the words "a newspaper with national circulation and in the Riigi Teataja Lisa" are substituted by the words "the official publication Ametlikud Teadaanded";

7) in subsection 375 (1), the words "a newspaper with national circulation and in the Riigi Teataja Lisa" are substituted by the words "the official publication Ametlikud Teadaanded";

8) in subsection 513 (3), the words "Riigi Teataja Lisa" are substituted by the words "official publication Ametlikud Teadaanded".

§ 39. Amendment of Marital Property Register Act

The Marital Property Register Act (RT I 1995, 87, 1540; 1996, 51, 967; 1999, 10, 155; 2001, 56, 336; 93, 565; 2002, 53, 336) is amended as follows:

1) in subsection 14 (2), the words "Riigi Teataja Lisa" are substituted by the words "official publication Ametlikud Teadaanded";

2) in subsection 30 (1), the words "Riigi Teataja Lisa" are substituted by the words "official publication Ametlikud Teadaanded".

§ 40. Amendment of Foundations Act

In subsection 53 (1) of the Foundations Act (RT I 1995, 92, 1604; 1996, 42, 811; 1998, 36/37, 552; 59, 941; 1999, 10, 155; 2000, 55, 365; 2001, 56, 336; 93, 565; 2002, 53, 336), the words "a national newspaper and in the Riigi Teataja Lisa" are substituted by the words "the official publication Ametlikud Teadaanded".

1) subsection 29 (3) is amended and worded as follows:

"(3) A regulation of the Government of the Republic enters into force on the third day after publication in the Riigi Teataja unless a later date is provided for in the regulation.”;

2) the second sentence of subsection 51 (5) is amended and worded as follows: “A regulation of a minister enters into force on the third day after publication in the Riigi Teataja unless a later date is provided for in the regulation.”

§ 42. Amendment of Law of Succession Act

Subsection 118 (1) of the Law of Succession Act (RT I 1996, 38, 752; 1999, 10, 155; 88, 807; 2001, 56, 336; 93, 565; 2002, 53, 336) is amended and worded as follows:

"(1) A court may provide a term for acceptance or renunciation of a succession and send a written notice thereof to a person entitled to succeed, or publish a notice in the official publication Ametlikud Teadaanded. The term shall not be shorter than two months after receipt or publication of the notice.”

§ 43. Amendment of Non-profit Associations Act

In § 95 of the Non-profit Associations Act (RT I 1996, 42, 811; RT I 1998, 96, 1515; 1999; 10, 155; 23, 355; 67, 658; 2000, 55, 365; 88, 576; 2001, 56, 336; 93, 565; 2002, 53, 336), the words "Riigi Teataja Lisa" are substituted by the words "official publication Ametlikud Teadaanded".

§ 44. Amendment of Place Names Act

In subsection 12 (2) of the Place Names Act (RT I 1997, 1, 3; 1998, 59, 941; 1999, 10, 155; 2002, 63, 387; 90, 521), the words ", and in the Riigi Teataja Lisa" and the second sentence are omitted.

§ 45. Amendment of Databases Act

In subsection 24 (2) of the Databases Act (RT I 1997, 28, 423; 1998, 36/37, 552; 1999, 10, 155; 2000, 50, 317; 57, 379; 92, 597; 2001, 7, 17; 17, 77; 2002, 61, 375; 63, 387; 2003, 18, 107), the words "Riigi Teataja" are substituted by the words "official publication Ametlikud Teadaanded".

§ 46. Amendment of Ambient Air Protection Act

The Ambient Air Protection Act (RT I 1998, 41/42, 624; 1999, 10, 155; 95, 843; 2001, 50, 283; 2002, 61, 375; 63, 387) is amended as follows:

1) in subsection 12 (2), the words "a newspaper designated by him or her" are substituted by the words "the official publication Ametlikud Teadaanded";

2) in subsection 12 (3), the words "a local newspaper or a national daily newspaper designated by the Ministry" are substituted by the words "the official publication Ametlikud Teadaanded".

§ 47. Amendment of Waste Act

In subsection 42 (2) of the Waste Act (RT I 1998, 57, 861; 88, õiend; 1999; 10, 155; 23, 353; 95, 843; 2001, 16, 72; 43, 239; 50, 283; 56, 340; 93, 565; 2002, 61, 375; 63, 387), the words "a newspaper designated by the issuer of the permit" are substituted by the words "the official publication Ametlikud Teadaanded".

§ 48. Repeal of Act

The Riigi Teataja Act (RT I 1993, 20, 352; 1995, 19, 288; 1996, 49, 953 and 955; 1997, 81, 1361; 1998, 59, 941; 98/99, 1577; 107, 1765) is repealed.

§ 49. Restrictions on publication of notices in Riigi Teataja in 1999

1) Notices and other documents which are published in a national newspaper in 1999 on the basis of a contract entered into by the Ministry of Justice shall not be published in the Riigi Teataja Lisa as of 1 April 1999.

2) The publication of notices and other documents in a national newspaper as specified in subsection (1) of this section has the same legal consequences as the publication thereof in the Riigi Teataja Lisa.

§ 491. Publication of notices contained in earlier Acts

Notices the publication of which in the Riigi Teataja Lisa is prescribed by an earlier Act but which are not listed in § 2 or subsection 3 (1) of this Act shall be published in the official publication Ametlikud Teadaanded.

§ 492. Application of subsection 71 (4) of this Act upon submission of new consolidated text at same time with submission of amending legislation

The transition to the submission of a new consolidated text at the same time with the submission of amending legislation shall take effect not later than on 1 June 2006.

§ 493. Application of subsection 15 (1) of this Act upon electronic submission of documents

The transition to the electronic submission of legislation and other documents shall take effect not later than on 1 June 2006.

§ 50. Entry into force of Act

(1) This Act enters into force on 1 March 1999.

(2) Section 3, subsections 24 (1)-(3), §§ 25-27, §§ 29-40 and §§ 42-47 of this Act enter into force on 1 January 2000.
