Lastly, the Court would reiterate that like all the other substantive provisions of the Convention, Article 6 § 1 is intended to guarantee rights that are not theoretical or illusory, but practical and effective (see Artico v. Italy, 13 May 1980, § 33, Series A no. 37). This is particularly relevant with regard to Article 6 § 1, in view of the prominent place held in a democratic society by the right to a fair trial (see Prince Hans-Adam II of Liechtenstein v. Germany [GC], no. 42527/98, § 45, ECHR 2001 VIII). It must also be borne in mind that hindrance can contravene the Convention just like a legal impediment (see Airey v. Ireland, 9 October 1979, § 25, Series A no. 32).
