Law No. 654 of 13 October 1975 ratifying the International Convention on the Elimination of All Forms of Racial Discrimination (New York, 7 March 1966) (published in the Italian Republic’s Official Journal No. 337 of 23 December 1975), as amended by Law No. 205/1993.

 

Article 3

  1. Unless the fact constitutes a more serious offence and for the purposes of implementing provisions contained in Article 4 of the Convention:

 

  1. a) anyone who propagandizes ideas based on racial or ethnic superiority or hatred or incites to commit or commits acts of discrimination on racial, ethnic, national or religious grounds shall be liable to imprisonment for a term of up to one year and six months or a fine of up to € 6,000.00.
  2. b) anyone who, in any manner, incites to commit or commits violence or acts of incitement to violence on racial, ethnic, national or religious grounds shall be liable to imprisonment for a term of between six months and four years;

  1. Any form of organization, association, movement or group one of the purposes of which is to incite to discrimination or violence on racial, ethnic, national or religious grounds shall be prohibited. Anyone who participates in such organizations, associations, movements or groups or provides assistance to their activities shall be liable, on the sole ground of participation or assistance, to imprisonment for from six months to four years. Those promoting or leading such organizations, associations, movements or groups shall be liable, by this sole fact, to imprisonment for from one to six years.

 

3bis.* If acts of propaganda or instigation and incitement committed in such a way that give rise to a real risk of dissemination are wholly or partly motivated by denial [gross trivialisation or publicly condoning] ** of the Holocaust or crimes of genocide, of crimes against humanity and war crimes, as defined in Articles 6, 7 e 8 of the Statute of the International Criminal Court, ratified by Law No. 132 of 12 July 1999, the sentence shall be imprisonment for from two to six years.
