Law N° 205/1993 (Decree-Law No. 122 of 26 April 1993 converted into Law No. 205 of 25 June 1993 referred to as the “Mancino Law”)
Section 3 - Aggravating circumstances
1. Anyone who commits offences punishable with a penalty other than life imprisonment for discrimination or ethnic, national, racial or religious hatred purposes, or with a view to encouraging the activities of organizations, associations, movements or groups pursuing the same purposes, shall be liable to a penalty increased up to one half. (Hate crime)
2. Any mitigating circumstance, other than the one provided for by Article 98 of the Criminal Code, concurrent with the aggravating circumstance referred to under paragraph 1, may not be deemed equivalent or prevailing to the latter and any penalty reduction shall refer to the increased penalty resulting from the application of the above mentioned aggravating circumstance.” (Hate crime).

5. Provisions contained in Article 3 of Law No. 654 of 13 October 1975 shall also apply to manifestations of intolerance and religious bias.

Article 18 bis
1. Provisions contained in Article 3 of Law No. 654 of 13 October 1975, as subsequently amended, and in the Decree-Law No. 122 of 26 April 1993, converted, with amendments, by Law No. 205 of 25 June 1993, shall also apply in order to prevent and counter intolerance and violence acts against people belonging to linguistic minorities.

Article 3 – incitement to violence

1. Unless the fact constitutes a more serious offence and for the purposes of implementing provisions contained in Article 4 of the Convention:

a) anyone who propagandizes ideas based on racial or ethnic superiority or hatred or incites to commit or commits acts of discrimination on racial, ethnic, national or religious grounds shall be liable to imprisonment for a term of up to one year and six months and a fine of up to € 6,000.00.

b) anyone who, in any manner, incites to commit or commits violence or acts of incitement to violence on racial, ethnic, national or religious grounds shall be liable to imprisonment for a term of between six months and four years;
