Article 164-3

The acquisition, use, or disclosure of a commercial secret, as well as of confidential information,
for the purpose of inflicting harm on the business reputation or property of another businessman,
shall be punished by a fine of nine to 18 personal exemption amounts.

Article 166-9

The disclosure of information given to a specially authorized executive agency on questions of
financial monitoring, or the instance of giving such information, shall be punished by a fine of 100
to 300 personal exemption amounts.

Article 185-11

The disclosure of information on security measures applied to a person taken under protection shall
be punished by a fine of up to five personal exemption amounts.

Article 212-2

Violations of legislation on state secrets, in particular:
(1) failure to observe the legislatively mandated procedure for transfer of a state secret to
another state or an international organization;
(2) classification of information:
on the state of the environment, the quality of foodstuffs and consumer goods;
on accidents, disasters, dangerous natural phenomena, and other emergencies that have
occurred or may occur and threaten human safety;
on the state of public health, the standard of living, including nutrition, clothing, housing,
medical services, and social security, as well as on the sociodemographic situation, law and
order, education, and culture of the population;
on instances of violation of human and civil rights and freedoms;
on abuse of office by government agencies, local self-government bodies, and their
officials;
other information, access to which may not be restricted under the laws of Ukraine and
international agreements, the binding nature of which is granted by the Verkhovna Rada of
Ukraine;
(3) unjustified classification of information;
(4) assigning a classification code to the carriers of confidential or other secret information
that does not constitute a state secret, or not assigning a classification code to
information carriers that constitute a state secret, as well as unjustified cancellation or
lowering of the classification code of the carries of secret information;
(5) violation of the legislatively mandated procedure for granting security clearance and
access to state secrets;
(6) failure to ensure the protection of state secrets and failure to ensure control over the
protection of state secrets;
(7) carrying out activities related to state secrets without receiving special permission as
duly envisaged for carrying out such activities, as well as placing government work
orders and completing mobilization assignments relating to state secrets in
government agencies, local self-government bodies, enterprises, institutions, and
organizations that have not been granted special permission to carry out activities
relating to state secrets;
(8) failure to comply with legislative requirements on protecting state secrets in the
course of international cooperation, during the reception of and work with foreign
delegations, groups, foreign individuals, and stateless persons;
(9) failure to implement regulations and requirements of cryptographic and technical
protection of classified information, leading to a real threat of violation of the
integrity of this information or its leaking via technical channels;
shall be punished by a fine of one to three personal exemption amounts imposed on citizens
and a fine of three to ten personal exemption amounts imposed on officials.
Repetition within one year of any of the violations set forth in part 1 hereof for which a
person was already disciplined administratively, shall be punished by a fine of three to eight
personal exemption amounts imposed on citizens, and by a fine of five to 15 personal
exemption amounts imposed on officials.

Article 212-5

Violation of the procedure for registering, storing, and using documents and other information
carriers containing confidential information that is the property of the state, which led to disclosure
of such information, shall be punished by a fine of one to two personal exemption amounts imposed
on citizens, and a fine of three to eight personal exemption amounts imposed on officials.
Repetition within one year of any of the violations set forth in part 1 hereof for which a person was
already disciplined administratively, shall be punished by a fine of two to seven personal exemption
amounts imposed on citizens, and a fine of eight to 13 personal exemption amounts imposed on
officials.
