THE RESOLUTION OF THE PRESIDENT OF GEORGIA

On the regulation of organization of the counterterrorist activity in the country and coordination of the activity of subjects involved in the struggle against terrorism

1. To approve pursuant to sub-item “a” of the Article 26 of the Law of Georgia “On Struggle against Terrorism”

a) The regulation of organization of the counterterrorist activity in the country and coordination of the activity of subjects involved in the struggle against terrorism (Enclosure # 1);

b) The list of the information support data on the joint counterterrorist activity (Enclosure # 2).

2. To insure the resolution on promulgation.

Enclosure # 1

The regulation on organization of the counterterrorist activity in the country and coordination of the activity of subjects involved in the struggle against terrorism

1. The Government of Georgia organizes struggle against terrorism in Georgia, provides it with special means and material resources.

2. The Ministry of Interior of Georgia, being the main authority in the joint state system of counterterrorism struggle, coordinates the counterterrorist activity defined with the Law of Georgia “On Struggle against Terrorism” realized by subjects involved in counterterrorism struggle (hereinafter the “Subjects”), originated within the frameworks of its competence, by Counterterrorism Center.

3. Reasoning from the purposes of the counterterrorist activity, the instructions and requirements of the Counterterrorism Center of the Ministry of Interior of Georgia are obligatory to the subjects for performance.

4. The Subjects and other authorities of the state government are liable to deliver any information approved in the sub-item “b” of the First Provision hereby in compliance to the “List of the information support data”.

5. On the basis of the obtained materials the Counterterrorist Center provides establishment of a sole and interconsistent informational base about counterterrorist situation and its dynamics; on the basis of through analysis of such information it establishes the presumptive threat of terrorism, will elaborate measures for prevention of terrorist activity.

6. At realization of the counter-terrorist activity special (operative, operative-technical) and operative-investigative measures the Counterterrorist Center and the Subjects are authorized to apply the abilities of other state authorities, their property and their technical and material base according to the regulation stated with the legislation.

7. After delivery of the information, stipulated in the item 4 of the given regulation the Counterterrorist Center defines the authorized competent subject (subjects), who would undertake the counter-terrorist activity related to the delivered information.

8. The Counterterrorist Center is authorized to request perfect materials related to the information stipulated in the item 4 of the given regulation from the respective state authorities.

9. At delivery of additional information as a result of counterterrorist activity the Counterterrorist Center defines expediency of continuance of special measures.

10. The Chief of the Counterterrorist Center reports on the counterterrorist activity realized in the country to the President of Georgia once a year through the Minister of Interior of Georgia.

List of the information support data on the joint counterterrorist activity

The following information (data) refers to the list of the information support data on the joint counterterrorist activity

a) About indications to attempt of possible encroachment upon life of state higher officials subject to state protection and members of their families, other state and political leaders;

b) About indications to preparation or realization of terrorist actions against diplomatic representatives of foreign countries and/or consulate institutions and citizens of foreign countries (temporarily) being in Georgia, their place of residence or vehicles;

c) About organized and planned terrorist actions against state and political leaders of foreign countries in Georgia including official delegations;

d) About detention, imprisonment, missing or perishing of Georgian citizens abroad if the specified action is related to terrorism;

e) About demonstration of indications of terrorism;

f) About such relations with foreign or terrorist organization, the purpose of which is organization and realization of subversive and terrorist actions in the territory of Georgia;

g) About cooperation of natural and legal persons with terrorists or terrorist organizations;

h) About realization of possible acts of terrorism against the President of Georgia; other political officials or members of their families including natural and legal persons subject to international protection;

i) About acts of terrorism against strategic, political or economical interests of Georgia;

j) About terrorist organizations and illegal armed groupings of terrorist nature operating in the territory of Georgia;

k) About illegal ownership with nuclear, radioactive, chemical and bacteriological weapon or other harmful for human health substances and occupation of objects of strategic and special significance with terrorist purposes.
