ORDER

No. 139, Date 19.06.2006

FOR

THE ESTABLISHMENT OF REGIONAL COMMITTEES FOR THE FIGHT AGAINST TRAFFICKING IN HUMANS AT QARKU LEVEL

In support to the paragraph 3 of the Albanian Constitution

I ORDER:

1. The Establishment of Regional Committees for the Fight Against Trafficking in Humans, both women and children, for the monitoring and coordination of the actions of the governmental and non-governmental parties at regional level, for the prevention of this phenomenon and for the protection of the trafficking victims.

2. The Committees are composed as follows:

- The Prefect of Qarku chairman

- The Mayor of the central Municipality of Qarku member

- The Director of the Regional Office of the State Social Services member

- The Director of the Regional Employment Office member

- The Director of the Regional Police Directorate member

- The Regional Director of the State Informative Service member

- The Director of the Regional Education Directorate member

- The Director of the Public Health Directorate member

The District’s Prosecutor, representatives from the civil society at regional level and from other agencies or organizations, whose mission and experience is related to the fight against trafficking in humans, could be invited to participate at committee meetings, if this is considered as necessary by the Committee members.

3. The Regional Committees for the Fight Against Trafficking in Humans will be responsible to identify priorities for action at regional level, in accordance with the National Anti-trafficking Strategies and also to make an assessment of the regional situation and specific needs.

4. Chairman of the committee is responsible for coordination of the participating members, exchange of information, sharing of responsibilities, and the implementation of regional priorities for anti-trafficking actions. Also, he will be responsible to report on behalf of the Regional Committee to the National Anti-trafficking Coordinator / Deputy Minister of Interiors on the implementation of anti-trafficking measures at regional level, at least, once in three months. The Regional Committee is, also, a local partner and contact point for the Responsible Authority for the implementation of the National Referral Mechanism for cases of trafficking victims.

5. Chairman of the committee will appoint a person from his office, who will be responsible to ensure administrative and logistical support to the work of the Regional Committee, and will serve as Technical Secretariat for the latter. This person will be responsible to keep the contacts with all member of the Regional Committee, collect and exchange information at regional level related to the anti-trafficking duties, and administer the data on concrete cases addressed by the Regional Technical Tables. Also, the Technical Secretariat will be responsible to communicate the data about the work indicators and the data on concrete cases to the Responsible Authority and the Office of the National Anti-trafficking Coordinator / Deputy Minister of Interiors.

6. The Regional Committee members appoint technical persons from their respective sectors, who will be responsible to: identify the priorities for regional anti-trafficking measures deriving from Anti-trafficking Strategies, to ensure their implementation in accordance to the measures anticipated for each institution, collect and exchange information; identify, refer and solve concrete cases; present the problems of the dynamics, and make efforts to solve them; determine the necessary measures to prevent trafficking and protect families, groups, persons and children at risk or potential to trafficking; and supervise the implementation of the local anti-trafficking duties, in accordance with the specific duties of each agency represented in this Committee. The Technical persons, appointed in this way, form the Regional Anti-trafficking Technical Table.

The members of the Regional Anti-trafficking Technical Table are:

- The representative of the Prefect, The Secretary General of the Regional AT Committee

- The representative of the Regional Directorate of State Social Service

- The representative of the Regional Office of Employment

- The representative of the Social Assistance Offices in Municipalities and Communes

- The Chief of the Regional Anti-trafficking Police

- The representative of the Regional Directorate of State Informative Service

- The representative of the Regional Education Directorate

- The representative of the Health Directorate (reproductive health)

- The representative of the District’s Prosecution Office

- Representatives from NGOs

The Technical Table convenes once in two months at least, and whenever is considered necessary by its members.

7. The meetings of the tables are called and directed by the Representative of Prefect’s Office, who is also the Secretary General of the Regional Anti-trafficking Committee. The protocol of the Technical Table meetings is kept by the representative of the Regional Office of the State Social Services.

This data are stored in an electronic database and are communicated to the Regional Committee and, through it, to the National Anti-trafficking Coordinator’s Office and line ministries, and to the Responsible Authority through the Secretary General of the Regional Anti-trafficking Committee, at least once in three months and whenever are requested by the latter ones.

8. The Regional Committees are responsible – within three months from entrance into power of this order – to outline their Action and Functioning Regulation and for the Regional Anti-trafficking Technical Tables.

9. Within three months from the entrance into power of this order, chairmen of the committees should report to the National Anti-trafficking Coordinator / Deputy Minister of Interiors on the undertaken steps for the implementation of this order.

10. The Prefect and institutions represented by members in these Regional Anti-trafficking Committees are obliged to follow up and implement this order.

This order enters into power immediately.
