On approving the State Programme

on Combating Trafficking in Human Being

for the period until 2010

With a view to ensure conditions aimed at combating trafficking in human beings and trafficking-related criminal activities, the Cabinet of Ministers orders the following:

1. To approve the State Programme on Combating Trafficking in Human Beings for the period until 2010 (hereafter referred to as the Programme), which is enclosed.

2. The Ministry for Family, Youth and Sports, as well as other relevant central bodies of executive power, shall allocate funds, on annual basis, for the implementation of the Programme within the expenditures assigned to them during the drafting of the state budget for the relevant year, and shall take measures aiming to attract funds for this from other sources.

3. While drafting local budgets for a respective year, the Council of Ministers of the Autonomous Republic of Crimea, oblast state administrations as well as Kyiv and Sevastopol City State Administrations shall allocate funds for the implementation of the Programme.

4. Central bodies of executive power responsible for the implementation of the Programme, the Council of Ministers of the Autonomous Republic of Crimea, oblast state administrations as well as Kyiv and Sevastopol City State Administrations shall provide information to the Ministry for Family, Youth and Sports, once in six months - before the 20th of the month following the reporting period, about the progress in the implementation of the tasks identified by the Programme.

Before 1 March every year, the Ministry for Family, Youth and Sports shall provide the Cabinet of Ministers of Ukraine with generalized information about progress in the implementation of the Programme.

of Combating Trafficking in Human Beings

for the period until 2010

General Part

One of the problems Ukraine as well as the world community faces today is trafficking in human beings.

Despite certain measures taken with a view to combat trafficking in human beings, the problem still remains critical.

This negative phenomenon can take various forms – from the abduction of people to their sale by means of deception, blackmail or by using their vulnerable condition. Victims of human trafficking are used in forced labour, in porno business, as donors for the transplantation of tissues and organs, etc.

The existing situation requires consolidation of efforts by central and local bodies of executive power and bodies of local administration as well as international and non-governmental organizations.

The Goal and Major Aims of the Programme

The goal of the Programme is to create conditions for combating human trafficking and trafficking-related criminal activities, to enhance the efficiency of work aimed at the identification of such crimes and persons committing such crimes, and to resolve problems related to reintegration of victims of trafficking in human beings.

The main tasks of the Programme are:

To improve the mechanism of normative and legislative regulations of the issues related to counteracting human trafficking and fighting against it, including them in educational curricular for children and youth;

To raise public awareness with the assistance of mass media, to enhance the efficiency of law enforcement activities in fighting against human trafficking;

To ensure efficient cooperation between the law enforcement agencies of Ukraine and other countries in combating trafficking in human beings;

To provide assistance to victims of human trafficking, namely in repatriation, employment and professional training;

To improve the activities of the rehabilitation centres in assistance to victims of human trafficking;

To develop mechanism for psychological and social rehabilitation of children suffered from human trafficking;

To cooperate with non-governmental and international organizations and foundations that are engaged in activities related to combating trafficking in human beings;

To use international experience in prevention and fight against human trafficking, protection of human rights of those suffered from the crime, search for those missing abroad, their repatriation and rehabilitation.

Measures indicated in the Appendix I are to be taken to implement the Programme.

Financial Support for the Programme

The Programme is to be implemented by central and local bodies of executive power using the funds assigned to them by the state budget and local budgets for a respective year as well as other sources.

The state budget funds allocated for the implementation of the Programme amount to 1,469,700 UAH.

Expected Results

The implementation of the Programme will contribute to:

Raising public awareness on the problem of human trafficking and, as a result, reduction of the amount of those becoming victims of the crime;

Incorporation of combating human trafficking topics into the educational curricular for children and youth, particularly in orphanages and boarding schools, in order to reduce their risk of becoming victims of sexual and labour exploitation;

Enhancement of professional knowledge and skills of experts within central and local bodies of executive power that are engaged in anti-trafficking activities by organizing the trainings for governmental officials and representatives of non-governmental organizations;

Improvement of the work of law enforcement agencies, enhancement of their cooperation with relevant agencies in other countries while investigating crimes related to trafficking in human beings;

Enhancement of the rehabilitation assistance provided to the victims, increase in the amount of persons reintegrated by improving social, legal, medical and psychological assistance provided to victims of human trafficking.

Prevention of Trafficking in Human Beings and Fight against it

1. To analyze legislative acts on combating trafficking in human beings and, if necessary, submit proposals to the Cabinet of Ministers of Ukraine regarding amendments to them.

4. To hear information, once in six months, from heads of central bodies of executive power engaged in anti-trafficking activities about the progress in the implementation of the State Programme on Combating Trafficking in Human Beings for the period until 2010 in order to assess its efficiency.

5. To organize annual regional and inter-agency meetings/seminars to coordinate the efforts, analyze and modify/specify the strategy to prevent human trafficking and fight against it.
