The Secretary of State, in exercise of the powers conferred upon him by sections 22(1A) and 28(1A) of thePrisons(Scotland) Act 1989[1]hereby makes the following Order a draft of which has been laid before and approved by resolution of each House of Parliament
1.—(1)ThisOrder may be cited as thePrisons(Scotland) Act 1989 (Release ofPrisonersetc.) Order 1995 and shall come into force on1st April 1995.
(2) In this Order "the Act" means thePrisons(Scotland) Act 1989.
EXPLANATORYNOTE(This note is not part of the Order)
This Order specifies a class of case for the purposes of sections 22(1A) and 28(1A) of thePrisons(Scotland) Act 1989 ("the Act").
The effect of Articles 2 and 3 of the Order is to provide that anyprisonerserving a sentence of imprisonment of less than 10 years who was sentenced before 1st October 1993, shall be released onlicenceunder section 22 of the Act by the Secretary of State where the Parole Board for Scotland so recommends. It also provides that where such aprisonerhas been released onlicencethe Secretary of State will be required to revoke hislicenceand recall him toprisonif the Parole Board so recommends.
