Cabinet of Ministers Resolution on the Establishment of the Interagency Coordinating Council for Combating Trafficking in Human Beings

Amended pursuant to CM [Cabinet of Ministers] Ordinances No. 1106 (1106-2003-p) of 17.07.2003, No. 1402 (1402-2003-p) of 04.09.2003, No. 946 (946-2004-p) of 26.07.2004, No. 1572 (1572-2004-p) of 17.11.2004, No. 305 (305-2005-p) of 20.04.2005

The Cabinet of Ministers of Ukraine   h a s   d e c i d e d   on the following:

1. To establish the Interagency Coordinating Council for Combating Trafficking in Human Beings.

2. To approve the Statute of the Interagency Coordinating Council for Combating Trafficking in Human Beings (appended hereto).

3. The Chairperson of the Interagency Coordinating Council for Combating Trafficking in Human Beings shall approve, within a month’s term, the personal composition of the Council.

(Throughout the text of the Statute the word “Derzhkomsimyamolod” ["State Committee for Family and Youth"], in all [grammatical] cases, has been substituted for by the word "Minsimyaditymolod" (“Ministry for Family, Children and Youth”), in the respective case, pursuant to CM Ordinance No. 1572 (1572-2004-p ) of 17.11.2004)

1. The Interagency Coordinating Council for Combating Trafficking in Human Beings (hereinafter referred to as “the Interagency Council”) is a standing consultative and advisory body under the Cabinet of Ministers of Ukraine, established with the purpose of coordinating the implementation of measures to combat trafficking in human beings.

2. In its activities the Interagency Council shall be guided by the Constitution of Ukraine (254k/96-VR), laws of Ukraine, acts by the President of Ukraine and the Cabinet of Ministers of Ukraine, as well as this Statute.

6. While performing its tasks, the Interagency Council shall interact with executive bodies, local self-government bodies, public organizations, as well as international organizations and relevant bodies of foreign countries.

The Interagency Council shall comprise the Minister for Youth and Sport (Chairperson of the Interagency Council), Deputy Chairperson of the Committee of the Verkhovna Rada of Ukraine on Legislative Provision of Law-enforcement Activities (Deputy Chairperson of the Interagency Council) (in case of consent), Head of the Department of Expert Examination and Analysis of Defensive and Mobilization Work, Activities of Law-enforcement and Judicial Bodies of the Secretariat of the Cabinet of Ministers of Ukraine, first deputies (deputies) of the Minister of Health, Minister of Education and Science, Minister of Justice, Minister of Finance, Minister of Internal Affairs, Minister of Labor and Social Policy, Minister of Foreign Affairs, deputies of the heads of the SBU [Security Service of Ukraine], the State Committee for Information Policy, TV and Radio Broadcasting, the State Statistics Committee, the State Committee for Entrepreneurship, the Administration of the State Border Service, the State Tourism Administration, the Ministry for Youth and Sport, the State Committee for Nationalities and Migration, as well as the Ombudsperson of the Verkhovna Rada of Ukraine (in case of consent).

The Interagency Council may comprise leading scientists, highly qualified practical specialists, representatives of public organizations and funds, including international ones.

8. The personal composition of the Interagency Council is to be determined and approved by its Chairperson.

The chairperson, his/her deputies and members of the Council shall participate in its work on a free of charge basis.

9. The form of work of the Interagency Council is its meetings, which shall be held whenever necessary, yet at least once every three months. The date and agenda of the next meeting are to be reported to the Council members no later than a week before the meeting.

The meetings of the Interagency Council are to be presided over by the Chairperson or, at the Chairperson’s request, by one of his/her deputies.

A meeting shall be legally competent when attended by no less than half of the members of the Council.

Invitations to participate in the meetings of the Interagency Council can be extended to officials from executive bodies, local self-government bodies, enterprises, institutions and organizations regardless of their form of ownership.

10. The Interagency Council shall determine the procedure of its work, make decisions within its competence, organize and provide for their implementation.

11. Decisions by the Interagency Council shall be made by open voting, requiring a majority of the votes of the Council members attending the meeting. In case the votes have been distributed equally the deciding vote shall be that of the Chairperson of the Interagency Council.

12. A decision by the Interagency Council is to be fixed in a protocol signed by the person presiding over the meeting. The decisions must be accepted for consideration by executive bodies and officials.

1З. Using mass media, the Interagency Council shall present regular reports on its activities to the public.

14. Organizational and technical support for the activities of the Interagency Council shall be provided by the Ministry for Youth and Sport.
