Cabinet of Ministers Decree

On Enactment of the Complex Program on Anti-Trafficking in Human Beings 2002-2005

5 June 2002, No. 766

The Cabinet of Ministers of Ukraine is enacting the following:

1. To approve the Complex Program on Anti-Trafficking in Human Beings for 2002-2005 (hereinafter the Program).

2. Ministries, other central executive organs responsible for implementation of the Program should stipulate costs for its implementation within the framework of funds determined by this organ in the State budget of the corresponding year.

3. Ministries, other central executive organs, Rada of Ministers of the Autonomous Republic of Crimea, oblast, Kyiv and Sevastopol local state administration:

4. Inter-department Coordination Rada on trafficking issues should perform coordination of measures determined by the Program.

I.   Prevention of trafficking in human beings

1. To submit proposals to the Cabinet of Ministers of Ukraine on establishment of Inter-department Coordination Rada on anti-trafficking in human beings as well as to establish permanent regional committee on coordination and exchange of information on anti-trafficking in human beings and to support its work.

2. To conduct annual regional and inter-department seminars on coordination issues, performing analysis and clarification of the strategy for realization of measures on anti-trafficking in human beings.

3. To provide sociological and criminological researches on trafficking in human beings issues, to summarize information and according to the results to submit the corresponding proposals to the Cabinet of Ministers of Ukraine.

4. To continue work on further studying, comparative analysis, conclusions and distribution of the international experience in Ukraine on anti-trafficking in human beings.

5. To provide professional guidance services and to organize professional studying of unemployed, especially young people by profession required at labor market (taking into consideration regional specifics).

6. To solve the problem of employment of graduating students of vocational-technical schools and institutions of higher education, who are prepared under state order.

7. To contribute to employment of young people who applied to the state employment center.

8. To continue supporting entrepreneurial activity among women in small and medium business.

9. To continue work related to involvement and support of unemployed women in their entrepreneurial activity.

10. To control permanently the activity of the tourist firms, marriage agencies and subjects of the market participants who has license for economic activity through the mediation in employment abroad.

11. To ensure observance of legislation during the period of rehabilitation and health promotion of children abroad as well as by health and other institutions where orphans and children whose parents were deprived of parental rights are treated.

12. To provide systematic consultations and clarification as well as addressed assistance to persons of the risk group.

13. To organize on the basis of scientific methodic registration of people who could be subject for trafficking in criminogenic regions and to provide individual and prophylactic work with them.

14. To increase level of information awareness of the population on measures and methods used by traffickers in human beings as well as potential risk of exploitation, violence and misuse of illegal migrants. To organize systematically information and education campaign to prevent trafficking in human beings. To create special set of TV and radio programs, to initiate separate sub-division in mass-media where consequences of illegal migration abroad for employment could be published.

15. To continue preparatory work and publishing of information on problem of social protection of children and youth.

16. To prepare and provide edition of Encyclopedia of legal knowledge for children and youth.

17. To support conducting of standing regional seminars for the employees of “hot-lines”, “trust-lines”, volunteers for providing them information and practical assistance on anti-trafficking in human beings.

18. To provide information, consultancy and legal assistance to citizens of Ukraine who is leaving for employment abroad, for holidays, rehabilitation and other purposes.

19. To continue providing measures related to development and initiating post-graduate pedagogical education in regional institutes, to study special course on anti-trafficking in pedagogical institutes.

20. To continue conducting thematic studies on anti-trafficking in human beings within the framework of implementation of the sex education program and providing consultancy in family-planning centers, crisis centers for women and youth.

II. Persecution of traffickers

21. To conduct measures on preparation for duly ratification of the UN Convention Against Transnational Organized Crime, Protocol Against the Smuggling of Migrants by Land, Sea and Air and Protocol to Prevent, Suppress and Punish Trafficking in Persons, Especially Women and Children, punishment for that and to bring legislation of Ukraine in line with its main clauses.

22. To improve mechanism of providing constant exchange of information among lawful organs and persons dealing with trans-border trafficking in human beings as well as methods and procedure of investigation and detection of crimes related to trafficking.

23. To reinforce border control of persons who could be victims of trafficking. To equip check points of state border with automatic complex of border control as well as to supply with all necessary information materials on prevention of trafficking in human beings.

24. To provide information to lawful organs on a regular basis on facts of detaining of persons during their attempt to illegally cross the state border having faked documents as well as deportation of persons suffered from trafficking.

25. To provide development and implementation of the mechanism of effective protection of persons taking part in criminal procedure especially in crime investigation as well as in legal investigation of criminal cases related to trafficking.

26. To continue cooperation with Interpol, Europol, Regional center of South-European Cooperation Initiative (SECI) on anti-trafficking in human beings, exchange of practical experience and information related to detection of victims of trafficking as well as persons who is privy to crimes of the above-mentioned category.

27. To provide training for employees of lawful organs on prevention of trafficking, bringing to responsibility of offenders, protection of victims and witnesses.

III. Protection of victims and their reintegration.

28. To provide assistance to return citizens of Ukraine who became victims of trafficking.

29. To provide necessary medical, psychological and legal assistance to victims of crime related to trafficking in human beings or other brutal actions.

30. To support development of network of reintegration centers for victims of crime related to trafficking in human beings and other brutal actions.

31. To develop and approve standard provisions on reintegration and anti-crisis centers and shelters for persons suffered form crimes related to trafficking and other brutal actions.

32. To continue work on conducting inter-field round tables on prevention of trafficking in human beings, improvement of the mechanism of assistance to victims of such crimes for the employees of central and local organs of executive power, lawful organs, diplomatic missions and consular departments, educational institutions, health and social protection institutions, migration and border services as well as representatives of public organizations.

33. To provide involvement of international and public organizations, charity foundation to the projects on prevention and struggle with trafficking in people, protection of human rights of people suffered from trafficking, detection of people disappeared abroad, returning and rehabilitation of victims of trafficking.
