Draft Amendments to the Criminal Code

[Article 130 Trafficking in Human Beings]

Paragraph 1

Trafficking in human beings is purchase or sale of people with or without their consent by means of deception, attraction, hiding, handing over, transportation, kidnapping, forgery, abuse of a person’s disability, giving bribe for acquiring consent of a person controlling another person, as well as other forms of compulsion with the purpose of further sale, involvement in sexual or criminal activity, use in armed conflicts, pornograpy, forced labour, slavery or likewise activity, debt related detention, or adoption of children with commercial aims".

Footnote to paragraph 3

"A person that committed offences envisaged in this article that voluntarily informs the relevant bodies and liberates a victim of trafficking in human beings, in case of absence of a criminal content in his deeds, is relieved of criminal responsibility" .

[Article 167. Trafficking in minors]

The sanction for trafficking in minors, that is purchase or sale of the wittingly minor persons irrespective of the forms and types of compulsion, -is fixed in the form of imprisonment for the period from five up to eight years with the confiscation of property.

The sanction for deeds envisaged in the part 1 of this article, if:

is fixed in the form of imprisonment for the period from eight up to twelve years with the confiscation of property.

The sanction for deeds, envisaged in the first and second parts of this article if they:

is fixed in the form of imprisonment from twelve up to fifteen years with the confiscation of property.
