CODE OF ADMINISTRATIVE OFFENCES

(N 8073-X  of 7 December 1984)

Article 185. Persistent resistance to lawful orders or requests of police officials, members of the volunteer group for protection of public order and state borders, or military personnel

Persistent resistance to lawful orders or requests of police officials on duty or resistance to orders of members of the volunteer group for protection of public order and state borders or of the military personnel involved in protection of public order  -

is punishable by a fine of at least eight and no more than fifteen tax-free minimal incomes or by  correctional labour for a term exceeding one but not exceeding two months with twenty percent of the salary deducted in favour of the state, or in the case when the circumstances of the case and/or personal circumstances of the offender make these measures insufficient, offence is punishable  by an administrative arrest for up to fifteen days.

Article 185 1. Violation of the procedure of organising and holding assemblies, meetings, rallies and demonstrations

Violation of the established procedure of organising and holding assemblies, meetings, rallies and demonstrations -

is punishable by a warning or by a fine of no less than 10 and no more than 25 tax-free minimal wages. 

In case of this offence being committed repeatedly within one year after an administrative sentence has been passed or it being committed by the organiser of the assembly, meeting, rally or demonstration -

it is punishable by a fine of no less than 20 and no more than 100 tax-free minimal wages or by correctional labour for a term of no less than one and no more than two months with twenty percent of the salary deducted in favour of the state, or by an administrative arrest for up to fifteen days.

Article 185 2. Creating conditions for organisation and conduct of assemblies, meetings, rallies and demonstrations that violate the established procedure for conduct of assemblies, meeting, rallies or demonstrations

Officials providing premises, transport, equipment or creating other conditions for organisation and conduct of assemblies, meetings, rallies and demonstrations in breach  of procedure established by law -

are liable punishable to a fine of no less than 20 and no more than 100 tax-free minimal wages.
