To ensure implementation of the law of the Republic of Armenia on "Legal Status of Foreign Citizens in the Republic of Armenia"

1. General Statements

1. These regulations govern matters related to issue and extension of entry visas to foreign citizens and stateless persons (hereafter referred to as foreign citizens), their resident status in the Republic of Armenia and issue of documents related to that status, registration, as well order of business activity of the mentioned persons.

2. Foreign citizens residing in the Republic of Armenia over 3 months must undergo registration by place of residence in the same order as prescribed for citizens of the Republic of Armenia.

Registration of staff members of foreign diplomatic or consular representations and international organizations with diplomatic status in the Republic of Armenia shall be carried on in compliance with international legal norms.

3. Registration order of persons having arrived in hotels, rest homes, health resorts or tourist centers shall be defined by the Ministry of Internal Affairs of the Republic of Armenia.

4. Foreign citizens must have internationally acknowledged personal identifications (hereafter referred to as passport) and provide it if requested by the Internal Affairs entities or other entities of the Republic of Armenia. In the event of loss of passport, foreign citizens must immediately inform the relevant entity of Internal Affairs. At the request of a foreign citizen, he/she may be issued a note certifying loss of passport (form No 1).

5. Internal Affairs entities are responsible for control over arrival, stay, movement of foreign citizens in the Republic of Armenia and transit through the Republic of Armenia.

2. Issue of RoA Entry Visa to Foreign Citizens and Extension of Entry Visas

6. Foreign citizens enter the Republic of Armenia on the basis of the RoA entry visa issued by relevant entities of the Ministry of Foreign Affairs and Ministry of Internal Affairs (form No 2).

7. To obtain an entry visa to the Republic of Armenia a foreign citizen must provide: passport, official invitation approved by the Ministry of Foreign Affairs, or personal invitation issued by the Ministry of Internal Affairs and an application form (form No 3).

The decision on issuing an entry visa to foreign citizens having arrived at a border point of the Republic of Armenia without visa shall be taken by relevant entities of the Ministry of Foreign Affairs or Ministry of Internal Affairs.

Foreign citizens having applied for an entry visa to the Republic of Armenia for a period of more than three months shall provide an AIDS certificate.

8. Staff members of diplomatic missions or international organizations with diplomatic status in the Republic of Armenia and their family members shall be issued entry visas to the Republic of Armenia, and visas shall be extended by the entities of the Ministry of Foreign Affairs of the Republic of Armenia.

9. Upon entry to the Republic of Armenia, foreign citizens must provide entry visa, passport and complete a declaration (form No 4) at the border crossing point.

10. Entry visas of foreign citizens having arrived in the Republic of Armenia for purpose of service, trade or public affairs, studies, practice, enhancement of qualification, employment, medical treatment or rest, may be extended at the mediation of the enterprises, offices or organizations, as well as state entities having received them (hereafter referred to as organizations).

11. Entry visas of foreign citizens having arrived in the Republic of Armenia on the basis of a personal invitation may be extended on the basis of the application filed by the person having invited him/her to the Republic of Armenia.

12. Entry visas of foreign group tourists having arrived in the Republic of Armenia may be extended on the basis of an application filed by the organization having received them in the Republic of Armenia.

Entry visas of individual foreign tourists having arrived in the Republic of Armenia may be extended on the basis of their application.

13. For extension of entry visas of foreign citizens organizations or persons having received them shall provide the following:

written mediation (application)

passport of the foreign citizen

the entry visa

application form.

3. Granting Resident Status to Foreign Citizens in the Republic of Armenia and Extension of Resident Status

14. Application of foreign citizens for a resident status shall be filed to the relevant entities of the Ministry of Internal Affairs in the Republic of Armenia, and to relevant entities of the Ministry of Foreign Affairs in foreign states.

15. To obtain or extend a resident status, foreign citizens must provide the following:

application (form No 5)

form (No 6)

two 4.5´3.5 size photos

passport

if necessary, copy of the employment or other contract

other documents required.

Apart from documents required in accordance with this item, foreign citizens having entered a state or accredited or licensed higher educational institution in the Republic of Armenia, must also provide a certificate from the educational institution; refugees must provide a document certifying their refugee status.

16. Exclusive resident status is granted to foreign citizens and resident status dates are extended by relevant entities of the Ministry of Foreign Affairs.

17. Decisions on granting and extending temporary and ordinary resident status shall be taken by the relevant entity of the Ministry of Internal Affairs of the Republic of Armenia.

Foreign citizens having been granted temporary, ordinary or exclusive resident status, shall be issued a resident card (form No 7).

In the event of loss of the resident document, foreign citizens must inform the Internal Affairs entity, which will replace the lost document with a new one.

For loss of the resident card, foreign citizens bear the same responsibility as prescribed for citizens of the Republic of Armenia, except for holders of exceptional resident status.

18. For issue and extension of temporary, ordinary and special resident status, foreign citizens shall pay a state tax in the order and amount stipulated by the law.

19. Foreign citizens, except for holders of exceptional resident status, may apply to the local Employment Center to get a job, as stipulated by the law of the Republic of Armenia on "Employment".

20. Labor relations of foreign citizens having resident status shall be governed by Labor code of the Republic of Armenia.

Labor disputes of foreign citizens having resident status shall be settled in accordance with the legislation of the Republic of Armenia.

21. Foreign citizens having ordinary resident status and wishing to leave Armenia for more than six months, shall file an application to the relevant entity of the Ministry of Internal Affairs, attaching the passport and the resident card. In the event of resolution of the issue in the favor of the foreign citizen, the following words shall be recorded in the "Observations" section of the resident card: "Exit from the Republic of Armenia is authorized "_____" _________ " this being sealed and signed.

In the event of refusal, a based written reply is provided.

4. Order of Deportation of Foreign Citizens with Exceptional Resident Status from the Republic of Armenia

22. Issues related to deportation of staff members of diplomatic missions and consular representations of foreign states and their family members having exclusive resident status from the Republic of Armenia in the administrative order, shall be governed by norms of the international law.

The Ministry for Foreign Affairs of the Republic of Armenia informs the international organization or its representative in the Republic of Armenia about deportation of the foreign citizen having exclusive resident status and being a staff member of that international organization from the Republic of Armenia in the administrative order.
