CONSTITUTIONAL LAW

ON TEMPORAY INABILITY
OF THE PRESIDENT OF THE REPUBLIC OF CROATIA
TO PERFORM HIS DUTIES

Article 1

The Speaker of the Croatian State Parliament shall substitute for the President of the Republic of Croatia in case of his temporary inability to perform his duties.

Article 2

Temporary inability of the President of the Republic of Croatia shall come into force when the President makes a statement in a public written decision to that effect.

If reasons for temporary inability exist, and the President of the Republic of Croatia is not in a position to publicly make a statement to that effect in his written decision, the Government of the Republic of Croatia shall submitt to the Constitutional Counrt of the Republic of Criatia a proposal on establishment of temporary inability.

Article 3

The Government of the Republic of Croatia shall initiate the procedure for establishment of temporary inability, if the President of the Republic of Croatia does not perform his duties, at the latest within 30 days of the day it has been determined the President of the Republic of Croatia cannot perform his duties.

Article 4

The Constitutional Court of the Republic of Croatia shall pass a decision on the proposal of the Government of the Republic of Croatia Government on establishment of temporary inability of the President of the Republic of Croatia within 24 hours from receipt of the proposal by the Government of the Republic of Croatia.

Article 5

The Constitutional Court of the Republic of Croatia shall act solely within the terms of the proposal of the Government of the Republic of Croatia.

Article 6

Pursuant to the decision of the Constitutional Court of the Republic of Croatia, the temporary inability of the President of the Republic of Croatia lasts 60 days.

In case reasons for the temporary inability of the President of the Republic of Croatia still exist upon expiration of the period from Paragraph 1 of this Article, the Government of the Republic of Croatia shall propose to the Constitutional Court of the Republic of Croatia to re-establish temporary inability of the President of the Republic of Croatia.

Article 7

Temporary inability of the President of the Republic of Croatia to exercise his powers and duties shall cease when the President starts to perform them.

Article 8

Upon expiration of the term in office of the House of Representatives of the Croatian State Parliament (by dissolution or expiration of the constitutional term) the Speaker and Deputy Speakers of the House of Representatives of the Croatian State Parliament shall continue performing their duties and powers until the new House of Representatives of the Croatian State Parliament has been constituted and election of the new Speaker and Deputy Speakers of the House of Representatives has been carried out.

Article 9

This Constitutional Law shall come into force on the day of its adoption and proclamation by the House of Representatives of the Croatian State Parliament, and its publication in the "Official Gazette".
