amending Law of the Czech National Council No. 40/1993 CoIl. on the acquisition and loss of nationality of the Czech Republic, as amended by Law No. 272/1993 Coil. and by Law No. 140/1995 CoIl.
The Parliament has passed the following Law of the Czech Republic:
Art. I
Law of the Czech National Council No. 40/1993 Coil. on the acquisition and loss of nationality of the Czech Republic, as amended by Law No. 272/1993 CoIl. and by Law 140/1995 CoIl., is amended as follows:
1. In paragraph 11 I after paragraph 2 shall be inserted new paragraph 3 which shall be as follows:
,,(3) The Ministry of the Interior may moreover waive the condition stated in Paragraph 7, paragraph 1 sub-paragraph c) in case of a national of the Slovak Republic or former national of the Slovak Republic who has had continuous permanent residence on the territory of the Czech Republic from 31 December 1992 at the latest."
Previous paragraph ,,(3)" shall be hereby designated as paragraph ,,(4)".
2. In Paragraph 13, shall be omitted sub-paragraph a) and previous sub-paragraphs "b)" and "c)" shall be hereby designated as sub-paragraphs "a)" and "b)".
3. Paragraph 14, including the heading, and paragraph 15 shall be omitted.
4. In Paragraph 16, paragraphs 1-3 shall be as follows:
,,(1)" A national of the Czech Republic residing abroad who is at the same time alien
may state that he renounces nationality of the Czech Republic.
(2) The statement under paragraph 1 shall be made at a Diplomatic Mission of the Czech Republic. The applicant shall state -
a) when he acquired nationality of a foreign state,
b) the last place of his/her permanent residence on the territory
of the Czech Republic, or that he/she never permanently resided there. Document proving nationality of the Czech Republic and document proving that applicant acquired nationality of a foreign state shall be attached to the statement.
(3) Parents or, as the case may be, one parent may include into the statement under paragraph 1 a child under 15 years of age who is national of the Czech Republic and at the same time alien. The following documents shall be attached to the statement:
a) birth certificate of the child,
b) consent of the other parent to loss of nationality of the Czech Republic by the child, provided that the parent has not been deprived of his/her parental rights or legal capacity,
c) document proving that the child has acquired nationality of a foreign state."
5. In Paragraph 26, shall be omitted the words "In Paragraph 15, paragraph 2 sub- paragraphs a) and c) and in paragraph 3 sub-paragraph a)."
6. In Paragraph 27a, after the word "lodged" shall be inserted the following words: "according to the Law of the Czech National Council No. 39/1969 CoIl., on the acquisition and loss of nationality of the Czech Socialist Republic, as amended by the subsequent regulations,".
Art. II
This Law shall take effect on the day of its promulgation.
