On Approval of the Rule of Annual Registration (Issuance of Card) of Internally Displaced Person - Persecuted
Based on paragraph 2 of Article 4 of the Law of 28 June 1996 on Internally Displaced Persons –Persecuted, with regard to the rule of annual registration (issuance of card) of Internally Displaced Person – Persecuted, I order:
1. “Rule of Yearly Registration (Issuance of IDP Status Card) of Internally Displaced Person – Persecuted” shall be approved, which shall be based on the universally recognized principles and norms of international law on defining procedure for determining legal status of rule of recognizing a person as displaced.
2. Mr. T. Lomaia, Deputy Minister of Refugees and Accommodation shall carry out control over the implementation of the order.
3. The Order shall enter into force upon its publication.
4. Order # 17 of the Minster of Refugees and Accommodation on “Rule of Yearly Registration (Issuance of IDP Status Card) of Internally Displaced Persons – Persecuted for the year 2002” dated September 28 2001 shall be repealed.
5. Order # 16 of the Minister of Refugees and Accommodation on “Rule of Yearly Registration (Issuance of IDP Status Card) of Internally Displaced Persons – Persecuted” dated August 22 2002 shall be void.

THE RULE OF ANNUAL REGISTRATION (ISSUANCE OF IDP CARD) OF INTERNALLY DISPLACED PERSON – PERSECUTED
1. Internally displaced person (IDP) is a citizen of Georgia or stateless person permanently residing in Georgia, who was forced to leave place of his/her permanent residence and was displaced (within the territory of Georgia) as a result of threat to his/her or his/her family member’s life, health or freedom due to the aggression of foreign country, internal conflicts or mass violation of human rights.
2. The Ministry of Refugees and Accommodation through bodies of local governance (city municipalities and regional administration) shall ensure yearly registration of IDPs and issuance of status cards.
3. For the purpose of proper implementation of campaign for issuing status cards to IDPs, local administrators and mayors shall establish permanent commissions under city and regional administrations. Deputy heads of local administration and mayors, ensuring implementation of the given measure, are appointed as chairmen of the commission.
Regional departments of the Ministry coordinate activities of the commission.
4. In case of necessity, Council of Ministers of the Autonomous Republic of Abkhazia sends representatives of the relevant bodies to work in the commissions based on the prior written notification to the Ministry of Refugees and Accommodation.
5. Status cards are printed at the computer center of the Ministry of Refugees and Accommodation and are issued to IDPs of any age.
6. Facsimile of the Minister shall be affixed on the front page of the status cards.
7. For registration and obtaining of status card an IDP, on scheduled days, shall show up at the commission of the city or region according to his/her place of registration.
8. While issuing status cards, commission established at relevant city/regional administration is guided by the list printed at the computer center of the Ministry.
9. For obtaining new status card, a family member of full legal age of the family having one registration number shall show up at the commission established at the regional/city administration and shall present:
a) Identification card of Georgian citizen certified by the commission on personal identification;
b) Birth certificate for children under 16 certified by the commission on personal identification;
c) Valid IDP status card.
Remark: Copies of the above listed documents are not accepted.
10. Signature of the responsible person of the commission and stamp of the administration shall be affixed on the last page of the status card.
11. IDP, with his/her signature certifies receipt of the status card by him and his/her family members (separately for status cards issued to each of the family member) and accuracy of the data included in the list.
12. The commission is responsible for each issued status card.
13. In case some passport information of the IDP does not comply with the data of the computer center, the commission, based on the identification document, makes relevant corrections in the list and IDP status card and confirms them with the stamp.
14. IDP, who undergoes registration according to the schedule announced in advance and replaces his/her old status card, will receive financial allowance according to the applicable procedure.
15. Additional registration and replacement of old status cards for IDPs who fail to register and replace old status cards within the scheduled period (from November 18 December 31 inclusive), for the reasons independent from the ministry, shall be carried out in places at the permanent commissions from 1st until 5th day of each month. IDP belonging to this category shall receive any kind of governmental assistance after undergoing additional registration and receipt of new status card.
16. Registration Department of the Ministry of Refugees and Accommodation of Georgia forwards new status cards and lists of IDPs to responsible persons of the regional sub-departments or regional/city administrations.
Remark: According to paragraph 13, responsible member of the commission shall correct wrong data at the upper side of the data to be corrected. E.g. If name Elene is to be corrected, it shall be stroke out and name Lena shall be written above it and etc.
The entry – type of document: If an IDP presented Citizen’s Identification Card, word “Identification Card” will be written. In the entry “number of the document” personal number indicated at the upper part of the ID card, consisting of 11 digits shall be indicated.
Corrections in other entries shall be made according to the above-noted rule, i.e. wrong data shall be stroke out and new data shall be written on the top.
