Regulations regarding Personal Identity Documents of Asylum Seekers and Procedures for Issuance Thereof

Issued pursuant to Section 21, Paragraph two of the Asylum Law

I. General Provisions

1. These Regulations determine the form of personal identity documents of asylum seekers (hereinafter – documents) and the procedures by which the Department for Refugee Affairs of the Office of Citizenship and Migration Affairs (hereinafter – Department) shall issue the documents referred to.

2. The documents shall be issued to asylum seekers irrespective of their age for a time period until the taking of the final decision regarding the granting of refugee status or alternative status, or a decision regarding a refusal to grant the relevant status.

3. If the time period for the examination of the application of an asylum seeker regarding the granting of refugee or alternative status (hereinafter – application) is extended, but the term of validity of the previously issued document expires prior to the date when the decision is notified, the department shall issue a new document.

II. Information to be Included in the Documents

4. The documents – cards – shall be made in conformity with the sample specified in the Annex of these Regulations, and the following information shall be included therein:

4.1. the name of the issuing authority, the number of the document, the date and place of issue, the term of validity;

4.2. information regarding the asylum seeker:

4.2.1. the given name (names), surname;

4.2.2. the date and place of birth;

4.2.3. citizenship; and

4.2.4. if the asylum seeker is under 18 years of age, the given name and surname of the parents, the guardian or an independent authorised representative appointed by the Appeals Board for Refugee Matters shall be specified in the document. If a child is less than one year old, the colour of his or her eyes and the height shall be specified in the document;

4.3. a photograph of the asylum seeker; and

4.4. entries regarding the permission of the administration of the accommodation centre for asylum seekers to reside outside the accommodation centre for asylum seekers.

5. The given name and surname of asylum seekers shall be entered in the documents in conformity with the orthography rules of the Latvian language.

III. Issuance of Documents

6. The State Border Guard within five days of the receipt of a written application by an asylum seeker shall hand over to the Department the referred to application, two photographs of the asylum seeker (35 x 45 mm), which are made from the same negative and are in one block (the face of the person in the photograph shall be uncovered, without headgear), samples of palm and fingerprints (if the asylum seeker has reached 14 years of age), and other information regarding the asylum seeker, which information is at the disposal of the State Border Guard.

7. The Department shall issue the document within ten days of the receipt of an application.

8. Prior to the issuance of the document, an official of the Department shall inform the asylum seeker in a language he or she understands that in Latvia liability for knowingly providing false information has been specified.

9. When issuing  documents, an official of the department shall explain to the asylum seeker that he or she must, not later than within one day notify:

9.1. an official of the accommodation centre for asylum seekers – of the theft or destruction of the document; and

9.2. the relevant State Police institution – of the theft of the document.

10. Asylum seekers shall:

10.1. sign that the document has been received; and

10.2. certify with their signature that the official of the department upon issuing the document has warned them regarding the liability in case of knowingly providing false information.

11. The documents shall be issued repeatedly if:

11.1. the term of validity of the document has expired;

11.2. the document is damaged;

11.3. notes not provided for by regulatory enactments have been made in the document;

11.4. the given name or surname (given name and surname) of the person has changed;

11.5. the outer appearance of the asylum seeker has changed;

11.6. other information entered in the document has changed or inaccuracies have been determined in the document; or

11.7. the asylum seeker has notified in writing of the theft or destruction of the document in accordance with the procedures prescribed by Paragraph 9 of these Regulations.

12. In order to receive the document repeatedly, asylum seekers shall submit the following to the Department:

12.1. a submission;

12.2. the document to be changed, if such exists; and

12.3. two photographs.

13. Prior to a repeat issuance of the document, an official of the Department shall verify the identity of the person receiving the document.

14. The document shall be issued repeatedly by the Department within three days of the receipt of the documents referred to in Paragraph 12 of these Regulations.
