REGULATION ISSUED BY THE MINISTERS’ COUNCIL

On 17 September 1990

concerning the conditions, circumstances and procedures of the application of enforcement means by Police force members.

Pursuant to art. 16 section 4 of the Law of 6 April 1990 about Police force (Official Journal No. 30 title 179), the following is ruled:

§ 1. 1. Police force member is entitled to use direct enforcement means while observing the rules mentioned in art. 16 sections 1-3 of the Law of 6 April 1990 about Police force.

§ 2. 1.  Police force member shall use the direct enforcement means in such way that the subordination of persons to lawful regulations be related to minimum inconvenience.

3. Various direct enforcement means can be used simultaneously, if it be necessary to obtain subordination to issued orders.

§ 3. The Police force member has the right to use the following means of direct enforcement:

§ 4. In relation to females showing pregnancy symptoms, persons evidently under 13 years of age, senior citizens, and evidently disabled persons – only the overpowering physical techniques can be used.

§ 16.1. If in result of the use of direct enforcement means, an injury has occurred to given person,  the Police force member shall offer first aid, and - if needed – medical assistance to this person.

2. In all cases medical assistance shall be provided to pregnant women, in relation to whom direct enforcement methods had been used.

§ 17. 1. The Police force member shall register every fact of enforcement application in service register.

2. In cases mentioned in § 16, the Police force member shall formulate service note and submit it to immediate superior officer.

3. If – in effect of using direct enforcement means - a fatal injury/decease of human individual has occurred, the immediate superior shall promptly advise higher superior and the public prosecutor.

§ 18 The superior officers shall study the justifiability, conditions and enforcement means application by the subordinated Police members.
