REGULATION ISSUED BY THE COUNCIL OF MINISTERS
of 21 May 1996
concerning the special conditions and procedures related to the firearms use by Police force members

On the basis of art. 17 section 4 of the Law of 6 April 1990 about Police force, the following regulations are issued:
§ 1.1. Police force members are entitled to use firearms in relation to persons only in cases defined in art. 17 section 1 of the Law of 6 April 1990 about Police force.
2. The use of firearms shall be understood as firing a shot in direction of a person in order to overpower him/her, after unsuccessful exhaustion the procedures mentioned in § 3.
§ 4. Firearms shall not be used in cases mentioned in art. 17 sect. 1 subsections 6,7 and 9 of the Law in relation to women showing evident symptoms of pregnancy, persons looking to be under the age of 13, senior citizens, and evidently disabled persons.
§ 5.1. If - in effect of firearms use - a person has been injured, Police force member shall promptly provide first aid or cause the provision of medical aid to such person, while securing his/her personal safety.
§ 7. The obligations of superior officer mentioned in § 6 section 3 shall include the following:
1. investigation whether the firearms use or implementation of activities mentioned in § 3 was carried out according to regulations in force,
2. prompt advising of immediate superior about all cases of firearms use.
