Chapter XXVI

Crimes against the family and custodianship

Art. 207.

§ 1. Whoever abuses physical or psychical force in relation to the close person or another person remaining in close or transient relation to the perpetrator, or the juvenile or another incapacitated person due to his/her physical condition, is subject to the penalty of liberty deprivation from 3 months to 5 years.

§ 2. If the act mentioned in § 1 has been related to special cruelty, the perpetrator shall be subject to penalty:

of liberty deprivation from one year to 10 years, 

§ 3. If in consequence of the act mentioned in § 1 or 2, the victim undertakes suicidal attempt, the perpetrator of aforesaid act shall be subject to:

the liberty deprivation for the period of 2 – 12 years.

Art. 210.

§ 1. Whoever – in defiance to the obligation to take care of the juvenile below 15 years of age or the person incapacitated because of his/her psychical or physical condition -  abandons such person – is subject to liberty privation of up to 3 years.

§ 2. If the consequence of the act is the decease of person mentioned in § 1, the perpetrator is subject to the penalty of liberty deprivation for the period of 6 months to 8 years.

Art. 211.

Whoever against the will of the person appointed to effect the custody or surveillance, abducts or apprehends the juvenile below 15 years of age or the person incapacitated because of his/her physical or mental condition, is subject to the penalty of liberty deprivation up to 3 years,
