Governmental Emergency Ordinance n° 105/ 2001 on Romania's state border

Art. 70.

The entrance or exit of the country by illegal crossing of the state border is a criminal act and is punished with imprisonment from 3 months to 2 years.

If the act provided for in paragraph 1 has been committed so as to escape from a punishment, such act is punished with imprisonment from 6 months to 3 years.

Art. 71.

The act of a person who recruits, guides or leads one or more persons so as to cross illegally the state border, as well as of a person who organizes such activity is a crime and is punished with 2 to 7 years imprisonment.

The act of association of initiation of the association for the purpose of committing the act mentioned in paragraph 1 or joining or supporting in whichever form such an association is punished by 3 to 10 years imprisonment.
