Article 204 – Pandering

(1) Whoever hires, drives or seduces another person to engage in prostitution or whoever exploits the prostitution of another person shall be punished by imprisonment for a term of up to three years.

(2) Imprisonment for a term of one to five years shall be imposed provided that the offender commits the crime specified in para. 1 in a violent manner, threatens with violence or other severe damage or abuses emergency situation or dependence of another person.

(3) Imprisonment for a term of two to eight years shall be imposed, if:

a) the offender, by committing the crime specified in para. 1 or 2, generates considerable profit

b) the offender commits such crime as a member of an organised criminal group

c) the victim of such crime is a person younger than 18 years of age

d) the offender commits such crime abroad

(4) Imprisonment for a term of five to twelve years shall be imposed, provided that

a) the victim of the crime specified in para. 1 or 2 is a person younger than 15 years of age

b) such crime is committed in co-operation with an organised crime group operating in several states.

Article 246 – Trafficking in Women

1. Whoever entices, hires or transports a woman abroad with the intention to have her used there for sexual intercourse with another person shall be punished by imprisonment for a term of one to five years.

2. The offender shall be punished by imprisonment for a term of three to eight years,

(a) if he/she commits the act defined in para. 1 as a member of an organised criminal group

(b) if he/she commits such act on a woman younger than 18 years of age

(c) if he/she commits such act with the intention to have the woman used for prostitution.
