Decree #136 of March 20, 2006
On Measures for Gender Policy Improvement

Analysis of the situation in the Republic demonstrates that structural changes in politics and economy are not fully positive from the viewpoint of gender effects. No sufficient conditions for exercise of women’s rights and liberties on an equal footing with men have been created.

Forming of parity democracy requires involvement of both men and women’s capacity into development and decision-making processes. This is also the essence of international obligations of the Kyrgyz Republic under Beijing Plan of Actions, Convention on Liquidation of All forms of Discrimination against Women. Encouragement of men and women equality and empowerment of women act as pre-requisites of achievement of Millennium Development Goals by the country.

For the purpose of implementing international obligations of the Kyrgyz Republic in the area of gender equality and following article 42 of the Constitution of the Kyrgyz Republic and Law of the Kyrgyz Republic “On Fundamentals of State Guarantees for Gender Equality” I hereby resolve:

1. Consider is to be expedient to ensure no less than 30% of representation of women of the Kyrgyz Republic in the state and local self-government bodies, including at the decision-making level.

2. Heads of state bodies and local self-government bodies shall ensure equal conditions and opportunities for participation in the competition for a job vacancy in state and municipal bodies for persons of different gender.

3. Establish that draft normative and legal acts of the Kyrgyz Republic, developed by ministries, state committees, administrative agencies, other state bodies, local self-government bodies are subject to mandatory gender examination.
State bodies and local self-government bodies that act as initiators of developing legislative acts of the Kyrgyz Republic shall be responsible for gender examination of draft acts.

4. National Council on Women, Family Affairs and Gender Development under the President of the Kyrgyz Republic jointly with Ministry of Justice of the Kyrgyz Republic under the assistance of the civil society and international institutes to develop Regulation on the Procedure of Carrying out of Gender Examination of Draft Normative Legal Acts and to prepare appropriate conclusions and submit to the President of the Kyrgyz Republic for approval within 3-month period. To publish the present Regulation for broad dissemination and guidance of state bodies and local self-government bodies.

5. Control of execution of the present Resolution shall be entrusted on special representative of the President of the Kyrgyz Republic in Jogorku Kenesh, Government and judicial bodies.

6. The present Decree shall enter into force as of the date of publication.
