Article 132. Recruitment, transportation, transfer, harbouring or receipt of persons with the aim of exploitation

1. Recruitment, transportation, transfer, harbouring or receipt of persons by means of threat or use of violence not being in peril for life or health or with other forms of coercion, abduction, deception, abuse of a position of vulnerability or by giving or receiving payments or benefits to achieve the consent of a person having control over the person with the aim of exploitation
shall be punished with imprisonment from 3 to 6 years.

2. Recruitment, transportation, transfer, harbouring or receipt of persons with the aim of exploitation committed against:
1) Person under 18;
2) Person that does not completely or partially understand the nature and character of his/her act due to mental disorder or is deprived of the ability to control it:
shall be punished with imprisonment from 7 to 10 years.

3. Acts stipulated under parts 1 or 2 of this Article committed:
1) Against 2 or more persons;
2) By a prior agreement between a group of people;
3) By the use of an official post;
4) By a threat or use of violence in peril of person’s life or health:
shall be punished with imprisonment from 7 to 10 years.

4. Acts stipulated under parts 1 or 2 of this Article committed:
1) By an organized group;
2) Caused death or other grave consequences by negligence:
shall be punished with imprisonment from 10 to 15 years.

5. In this Article exploitation of persons shall be deemed engaging other persons in prostitution or other forms of sexual exploitation, forced labour or services, slavery or practices similar to slavery, taking of organs or tissues of a person.

Article 1321. Engagement of other persons in prostitution or other forms of sexual exploitation, forced labour or services, or slavery or practices similar to slavery

1. Engagement in prostitution of other persons or other forms of sexual exploitation, forced labour or services, slavery or practices similar to slavery by means of threat or use of violence not being in peril for life or health, or by other forms of coercion, abduction, deception, abuse of a position of vulnerability or by giving or receiving payments or benefits to achieve the consent of a person having control over the person:
shall be punished with imprisonment from 5 to 10 years.

2. The same act committed:
 1) Against person under 18;
 2) Against person that does not completely or partially understand the nature and character of his/her act due to mental disorder or is deprived of the ability to control it;
 3) Against 2 or more persons;
 4) By a prior agreement between a group of people;
 5) By the use of an official post;
 6) By a threat or use of violence in peril of person’s     life or health:
shall be punished with imprisonment from 7 to 12 years.

3. Acts stipulated under parts 1 or 2 of this Article committed:
 1) By an organized group;
 2) Caused death or other grave consequences by  negligence:
shall be punished with imprisonment for 12 to 15 years.

Article 261. Engagement in prostitution of other persons for profit

1. Engagement in prostitution of other persons for profit motives in the absence of crime features stipulated under Articles 132 and 1321 of this Code:
shall be punished with a fine in the amount of 200- to 300-fold of the minimal salary, or correctional labour for up to 2 years maximum, or imprisonment from 1 to 3 years.

2. The same act committed:
 1) By a prior agreement between a group of people;
 2) By the use of an official post:
shall be punished with imprisonment from 2 to 6 years.

3. Acts stipulated under points 1 or 2 of this Article committed:
 1) Against person under 18;
 2) Against person that does not completely or partially understand the nature and character of his/her act due to mental disorder or is deprived of the ability to control  it:
 3) By an organized group:
shall be punished with imprisonment from 3 to 8 years.

Article 262. Inciting to prostitution

1. Creating, managing or maintaining establishments for prostitution or using for prostitution some public facility or regularly providing apartment or other accommodation for prostitution of another person, or contributing to engaging in prostitution in other ways by gaining materials profit, in the absence of crime features stipulated under Articles 132 and 1321 of this Code:
shall be punished with a fine in the amount of 300- to 500-fold of the minimal salary, or correctional labour for up to 2 years maximum, or imprisonment from 1 to 4 years.

2. The same act committed:
 1) By a prior agreement between a group of people;
 2) By the use of an official post,
shall be punished with imprisonment for 2 to 6 years.

3. Acts stipulated under paragraphs 1 or 2 of this Article committed:
 1) By using a person under 18;
 2) By using a person that does not completely or partially understand the nature and character of his/her act due to mental disorder or is deprived of the ability to control it:
 3) By an organized group;
shall be punished with imprisonment for 3 to 10 years.
