Regulation on the implementation of the investigative measures on intercepting telecommunication, undercover agents and technical surveillance as proscribed under the Code of Criminal Procedure

Offences for which the measure is applicable

Article 8 –(1) Intercepting, recording and evaluating through signal data of telecommunication may only be implemented for offences specified under article 135, paragraph 6 of the Code of Criminal Procedure. In cases when offences specified under article 220, paragraphs 2, 7 or 8 of the Turkish Criminal Code (Law 5237) have been committed within the framework of activities of a terrorist organisation, it shall also be possible to resort to measures of intercepting, recording and evaluating through signal data of telecommunication.
(2) For the measure of Caller-ID detection regarding telecommunication, the conditions of the above paragraph are not necessary to be met.

Offences for which the measure is applicable

Article 18
–(1) The measure of technical surveillance may only be implemented for offences specified under article 140, paragraph 1 of the Code of Criminal Procedure. In cases when offences specified under article 220, paragraphs 2, 7 or 8 of the Turkish Criminal Code (Law 5237) have been committed within the framework of activities of a terrorist organisation, it shall also be possible to resort to the measure of technical surveillance.
Offences for which the measure is applicable

Article 26 –(1) The measure of appointing undercover agents may only be implemented for offences specified under article 139, paragraph 7 of the Code of Criminal Procedure. In cases when offences specified under article 220, paragraphs 2, 7 or 8 of the Turkish Criminal Code (Law 5237) have been committed within the framework of activities of a terrorist organisation, it shall also be possible to appoint undercover agents.
